A friend of mine has a bitch on breeding terms. Agreement  was that she paid for half of the bitches price and she was to use the breeders stud dog as the sire + plus take pick of litter. Breeder agreed to hand over pedigree + papers, when this has been done and pups ready for new homes.  The puppies are now 4 weeks old and the breeder of the bitch now wants 2 of the puppies instead + £400 stud fee.  He wont hand over anything until this has been agreed.  This breeder signed a written agreement saying all he wanted was one puppy from the litter and the stud rights ( use his dog ).   This person is getting aggressive towards may friend and she is devastated and very intimidated by him. She only has 3 in litter and now he wants 2 of them.  Surely the written agreement stands or does it???

I'm no expert on these matters, but suspect taking the agreement to a solicitor and getting them to check it over and possibly write a letter to the breeder might just solve the problem.

This should be a warning to all that partake in Breeding Terms!!! As I understand it the contract may not be worth the paper it's written on!!! Personnly I think you need to be on excellent, long term, friendly terms with the person you are involved with! Even that is no guarantee that things will work out or remain as they should! Maybe a call to the KC will help? But I honestly think your friend is on a hiding to nothing, especially when the other party is getting aggessive and intimidating! Go to a Soliciotr experienced in Contract or Tort Law and see what they say...are they still waiting for the Stud owner to sign the papers for registration too? All the best, Dawn

The KC won't help:rolleyes:  I would also get a solicitor but in reality I would never do this kind of thing without getting a solicitor involved right from the start.

I've heard quite a few people being done in this way or other ways which I think's disgusting and they've paid higher prices for the dogs than other well known breeders would charge!

I would never go there myself.  Seen it hurt too many people!

Trouble with solicitors is they can be expensive - it could cost her more than the value of a puppy, although I appreciate there is a point of principal here.
Having to pay the stud fee is maybe valid, depending upon what, if anything, was written down about that. Unless the agreement says free stud then its ok - though in my view not terribly moral.
If the agreement says pick of litter (1 pup) then thats what it says, and that is all the person can have.
As far as papers go etc, well the breeder will surely want to register her pup, so might get into difficulties here, and the KC could get involved over that.
