Topic Dog Boards / Health / CAN I SUE MY VET

i really need some help as to weather there is anything i can do
a specialist who was described as one of a kind did my dogs luxating patella operations.
however since the op in oct del legs have not improved at all if anything he has got worse. however the annoying thing is the specialist would not admit the op had not been succesful was very abrupt and rude to me. anyway on numerous occassions we made the long journey to take my dog back as to me  my dog was limping bad and i was worried about him. anyway each time i went down i was told my dog was fine and the op had been succesful and charged a good £80 fee. after returning three times to be told my dog  was now fully recovered and his legs were normal i decided to opt for a second opinion. i was told my dogs legs were coming in and out all the time were not fixed at all and my dog would end up with bad arthiritus if this was not fixed. the annoying thing is my dog went through so much and we payed 3 thousand approx in total to be no further forward. we now have to get the op dont again.
i am just so annoyed with the specialist because if i had not got that second opinion my dog could have been suffereing for years and me never knowing bacause he said my dog was fine. the vet also said the specialist would have definatly know dels legs were not fixed. also i feel i have been ripped off, why did he keep charging me telling me my dog was fine why did he not just say i am sorry the op has not been succesful rather than keep charging mr fees everytime i went down because iwas worried about my dog. i also think its strange that a 99 % sucess rate op has not been sucessful on even one of his legs.
thankyou for spending the time to read this and if annyone could give me any advice as to if there is anything i can do at all.

This tells you everything about how to make a complaint:

Did your insurance pay? You could mention it to them.

Yes you can.  The vet/specialist should have picked up on the fact the op was not a success on the first check up.  I am sure they did what they could in the op but that does not excuse the fact the check ups couldnt have been carried out correctly or fully.  I doubt you would get the money from the op back as an op is only a potential cure/fix not a guarantee.  Just a good job you got a second opinion.  Hopefully by a different vet you can get him sorted this time.

that is what i was so annoyed about because why did he not just say i am sorry but the op had not been sucessful (very strange how both legs have not been tho) but he never he said del was not fine and i took him back down on numerous occasions because i thought there was a problem and he kept charging me and telling me he was fine at one point he told me to not keep fetching him down because my dog was fine. also the last time i left which was last wed he charged me £150 to tell me my dog was fine and booked him in for some more x rays which i dont understand why, he had some x rays not long ago when i complained he was still limping and he told me the x rays were clear so why did he want to do more ?????

I can understand how frustrating this has been for you.  But, surgery isnt 100% guarentee.  Even though the surgery was not a success when this vet did it, it was a good thing to go to another.  But I dont know if you could actually sue the vet.  The vet performed the surgery, and you paid for that surgery, not actually the cure.  I really hope, I am not sounding rude, as my intentions are not to sound rude, just giving straight facts.  But it would be good to file a complaint.  There are also sites that you can go to, that you can "rate your vet".  Be careful though, if you are going to post anything, as it can be used against you.  Keep everything to the facts, and try to leave emotions out of anything written.  Say things like "on such and such a date, my dog had surgery and so far I have not seen improvement, but a decline in patella function"  instead of "this vet is a quack, he cant even do a surgery right, my dog isnt improving!"

He shouldnt have had you come three more times, and charged you all that.  Does he not have a recheck fee?  A lower price when you are bringing the dog in for the same issue?

But good for you to get another opinion from another vet.  Hopefully, this vet can get your dogs legs better.

hi yeah i do understand that there is not 100% gurantee but the annoying thing is was why did he not admit that it had not been sucessful and it would have saved me alot of money in keep going back down. the journey was a 3 hour round trip also and i was having to do it twice a day. the surgeon told me the sucess rate was 99.9% how come neither of his legs have worked and in my opinion has become worse, its just so annoying because this is ment to be a vet that takes care of my dog and in his words he only wanted the best for my dog well why was he willing to let my dog suffer by saying he was fine when he knew fine well he was not.
i am just so annoyed that my dog has to go through this all again

because the specialist only deals with a referrals he was charging me a referral fee every time i went down which is about £50 pond, however he was also giving me metacam so in total was paying about £100 which to me contridicts what he said why did my dog need metacam if he was in no pain?

I would have imagined that since the insurance company paid for the treatment it would be worth contacting them to let them know that it has been unsuccessful particularly if you have been given a second opinion to this effect. At the very least i would be asking them to consider paying for part of the new operation? Any surgery is a risk and I can see it might not be succesful in all cases but i can't understand why this vet would say it has been a success when it patently hasn't been?

i think he did not want to admit there has been problems. when i went down to see him the last time he would not let me get a word in and explain the problem therefore did not want to hear there was a problem. i feel like he was then trying to put the blame on me by saying i should have bought him down before now. well i did twice to both times have wasted my time with him telling me my dog was fine and to stop worrying. i even went to my local vet and got them to have a feel. they told me it felt loose so i went and explained this to him and his words were, its ment to feel loose. he also went on about how i was restricting my dogs exercise. even if i was what difference did that make to weather he limps or not ???? am i ment to drag my dog around a field limping????
i think because both legs had been unsucessful and he promised me they would work as he said the sucess rate was so high, and after all he was ment to be amazing at this type of ops, he felt like he would have had to re op for free and did not want to and thats why he did not admit there was a problem.
thankyou for all your help tho
