ok last saturday,someone hit the van from behind.
Because it was quite a big bang,police asked to see my documents ,which i didnt have on me. apperently this is a offense NOT to carry your "full" driving licsense (both parts card & paper) & full insurance documents.

ok i moved three weeks ago, & the dvla have my driving license,& its not going to be back in time for the 7 days.

i have a colour photocopy of it.
proof of posting with date
print out of when DVLA got it with sig
emails from DVLA sayoing its not ready & could be ANOTHER 20 days.

so potentially i could have to go to court because the DVLA are slow & ive complied with the law re sending off my docs for change of address.

any help/advise?

Well, I certainly don't carry all my documents - thats ridiculous. Imagine if the car got stolen with all your docs inside?!

I would go along to the police station with the proof of posting and copy etc and nicely explain that you are doing what is required by law - so how could you have the License on you?! I can't see that they can do anything about it to be honest!

Just go along with the document copies and emails and explain.  The police will understand.

According to DVLA website it is an offence anyway not to inform them of your correct name and address.  So you're OK on that one as you're doing what you're supposed to do - and quickly as well. You can't very well have your license on you when it's being used to comply with the law elsewhere.

Also, if the DVLA have your license or an application for a duplicate license, you are still allowed to drive provided that you haven't been disqualified, haven't been refused a license for medical reasons, there aren't any special conditions applying to the license and you're license was issued after 1 Jan 1976. 

Honestly don't see how you can be taken to court so I wouldn't worry.  Give the police the copies and if they insist then take the license in when you get it back.

Has the law changed? It used to be that you had to produce your documents within 7? days at the Police Station that you designated as your choice.  I wasn't aware that all of a sudden it is an offence!  I never carry my documents on me as that is a licence for thieves to not only duplicate for identity fraud (to open a bank account a driving licence or such documents are required) This doesn't make sense to me, I personally believe that you have only committed an offence if you don't produce the documents (hope I'm not wrong on that one)

yes but mine isnt going to be back by then.
it is a offense,but because they realise that people "wont" carry them,that is why they give you 7 days grace.

Michell, the Police have access to the DVLA database and can tell whether someone has a full license or not!!! Same way as they can with the Registration and MOTdetails of any vehicle...I wouldn't worry too much, like has been advised, take all the paper work to the Police and see what happens...how can you be a magician??!! Honestly Michelle, I don't think you will have anything to worry about.  It can be proven that you have sent your documents off so they would be very foolish to take it further, plus, if it did go to court I am sure the Magistrates would throw it out then give them a b****cking!

I certainly don't carry my documents with me for the reason already stated, theft of vehicle with the documents...how silly :eek:

I had to do a producer when I had an accident and hadnt long moved so didnt have my liscense, I phoned the DVLA and they gave me my liscense no. and I explained to the police why I didnt have the copy they were ok with it.
Havent they got anything better to, they can check whether you have insurance, tax, registration, liscense and now mot while you wait, I know this as I have been stopped lots because I work in a pub and leave about closing time and each time they insist on checking everything, not enoght crime to keep them busy:rolleyes:

Hi Mish,

If you still aren't reassured, I would phone/visit the Citizens Advice Bureau. With any luck, they will be able to find the exact legislation that relates to this sitiation.
Good luck, and don't get worried or intimidated. Take someone with you at all times so you've got an independent witness and moral support.
