i have just been down to the local pet shop and some one has taken a pic of my rottie and put it on there advert for stud dog, have just phoned the advert and they told me there is nothing i can do, i am furious the pet shop have taken the advert out the window, as i took my original pic down,the pic was taken by a proffesional photographer, and it has his copyright on.
just wanted to get this off my chest.

Are you saying that the photographer, who owns the copyright to the picture of the dog you own dog is advertising him at stud?
Are you the registered owner of the dog? If so, no-one else has stud rights over him!

I'm confused too...I read it to be that someone advertising a stud has used a picture of your dog? If so, is it the picture taken by the prof. photographer, and is he the one advertising the stud?
no the proffesional photographer has a web page, and my boys pic is on his web page, and somebody has downloaded the pic and used it as there own rottie pic,
so they have a rottie and they have taken a pic that is of my rottie and said it is theirs and he is at stud, my rottie can't be used at stud has no bits, so they are just using the pic of my rottie.

In that case, I think I would put my own picture up, showing my dog and saying that he is NOT at stud because he is knackerless :D

I would sue the person advertising, talk about breach of copy write! (They must have had their contact details on view)
Just to put a spanner in the works Judgedred are you absolutely sure it was your dog? We know what similarities our dogs can have we can spot them from their personalities and up close, but not always from a photo.
I have to say if anyone did that with one of my dogs, I would be straight to my solicitor!

Actually they ARE infringing copyright and can theoretically be prosecuted and fined a lot of money. If you can get their address which should be easy if they are advertising their dog at stud, I'd get the photographer to send them a letter stating that if they did not cease and desist using the photo immediately, the matter will be put it into the hands of a solicitor. If possible take photos of the advert in situ, photocopy these and send them a copy so they know they can't worm out of it. Should frighten the life out of them.
If that doesn't work, just stick an ad up as Margot suggested wherever you see the original ad. Id' put This dog is not for stud - he is neutered. The people using his photo illegally are falsely advertising and are obviously not confident in the appearance and conformation of their own stud dog so are ashamed to feature him! But then again, I'm a big meanie and probably would be done for libel - he-he!

I'm not surprised you're furious! Isn't the advertiser guilty of misrepresentation?

I think I would definitely do something along the lines of Lokis mum suggestion. Shouldn't take long for the original advertiser to take down 'their' picture

Same happened with us, when we were getting a puppy from a well known breeder I was looking through some free ad pages and saw a picture of the pup we were buying, advertising a litter of pups! Puppy breeder was not happy, but soon enough had it removed!

My friend was looking through her local paper and found a picture of my dog that she bred, sitting on his crate at Crufts, advertising coach trips to Crufts - they'd nicked a picture of him off our website. I was rather flattered actually, but my OH was furious and made them take it out!! I've still got the photo from the paper though!! :-D
