Hi

I am in the process of moving house...however in 2002 I was made bankcrupt and later discharged in june 2004.

When I did my mortgage application with my advisor se did not ask me if I had ever been made bankcrupt before. 

We have just got some of the seraches back and one as come back as showing I went bankcrupt n 2004, owever the offical reciever said that shouldnt be a problem as I am now discharged.

My solicitors assistent culdnt offer any advice as se has never delt with a bankcrupt search before and the soliciotr in charge is away until tuesday, however I am seriously stressed to hell with worrying and dont no what to do as I have already paid 3000 reservation fee on a new house and all the searched and servayer fees which are all no returnable.  Can anyone help or has anyone bee through this who could offer advice either on here or personally.

Well I'm not the conveyancing expert you were hoping for  ;) but it seems to me it is not your solicitor you want to speak to as they will be dealing with the sale rather than the mortgage. Surely it is your mortgage providers that will have any possible concerns about lending money to a discharged bankrupt (although I have no idea if they will find this a problem)  If they agree the mortgage the vendor gets paid off, once off, for sure, all time, so they are not going to be concerned about your history at all.

It is not conveyancing advice you need it is insolvancy.:-) you will need to go speak to the people who dealt with it as to why the dates are incorrect.

Generally speaking even if you hit a brick wall, if you have a reasonable deposit you can put down then most banks will still give you the mortgage.

PS all mortgage forms ask about your financial background so it is generally better to be upfront and lay your cards on the table first.  It may be a bit late now to give you this advice but searches always find these things so although I can understand someone hot wanting to shout from the roof top if you tell the FA firstly they can select the more sympathetic lenders.

thanks for all your help.  I told the FA in our initial interview but for some reason she hasnt put it n the form.  So back to the drawing board :-)
