my bitch was mated with a dog the same as her and her pedigree was endorsed,i understand i could mate but pups couldnt be registred,but the thing is i cant find my contract i know it said if i didnt want the dog i could take it back and recieve 1 pence for her,and that if she had to be put to sllep then the breeder would replace at the earliest convience(for bad hips)im realy scarsd as my breeder is going to her solicitos because she said it was in her contract signed by us that we musnt mate the bitch(i gave the pups to friends and family)but 1 person sold a pup on and contacted the kc club to see it he could reg his bitch they got oncontact with my bitches breeded will she take legal action on me please help i didnt mate for money and gave the pups away to i thought good homes so no money passed hands please help i worried to deaf been crying all day

You shouldn't have really bred the dog unless you asked the breeder to lift the endorsement, these are put on for a reason, why didn't you contact the breeder first?  I'm not sure about the legal side of the things,maybe someone can help you later.

My puppies are endorsed, and I heard recently from a third party that one of the owners was thinking of breeding. In order to be as diplomatic as possible, I sent a general E-mail to the owners of all the puppies I believe to be still entire, reminding them of the terms of the contract and that the endorsement would only be lifted if the puppy had satisfactory hip & eye scores, and similarly the stud/bitch to be used. Obviously if they decide to go ahead it's up to them, but the pups can't be kennel club registered. I may be a bit dense but I can't see the point of taking legal action At the end of the day one can only advise, but people will do what they will do....:-(. If the puppies are already here, and settled in their new homes, I can't see that the original breeder can do anything about it now.

to be honest i dont think a breeders contract holds up in court

The reason good breeders endorse registrations is nothign to do with the selling of pups but to hopefully ensure that any pups bred will be a credit to the breed, by being up to breed standard, healthy and bred with the breeds best interest in mind.

I can understand the breeder being upset with you as for all you know tha bitch may not be suitable to be bred from.  she may be untypical, have less than good hips, have or be the carrier of an inheritable eye condition etc, and whose repoutation would be tarnished, not yours but theirs.

As you also used a dog whose owner was willing to let their dog mate a bitch whose pups couldn't be registered it is almost certain that this was not a top qwuality dog,a dn may have been unsuitable himself or at very least an unsuitable match.

Breeders will help keen owners who want to do things properly, to breed a litter they can both be proud of giving all the guidance to help make this more likely.

Why did you not go to the breeder and ask them to help you do this????

We should probably leave you sweating as it was a bit of a naughty thing to do, YOU knew she wasn't to be bred from. It was a bit unfair of you to breed regardless who they went to and for how much. I will be suprised if you gave them away free though.

To cut you some slack and  give you the benefit of doubt so you can get some sleep I think you should be OK at the end of the day you did buy the bitch and a sale is a sale. Appoligise to the breeder and don't do it again.

YOu have to understand that the breeder put the endorsements on for a reason, to protect the offspring and the bitch.  The breeder herself is prbably worried sick were these unregistered puppies have ended up.. I know I would be. I don't understand why you didn't contact her and ask her approval unless you intended to try and hide it from her.  Lies are always found out. Doing this type of things does nothing for your reputation and may limit who you would be able to buy from again.

A down side of this and more imortantly, Puppies given away free, unregistered etc generally end up unwanted puppies taken at the spur of the moment. Which is awful.

You bought a bitch from a good caring breeder and have, in turn betrayed that breeder. I am afraid I sympathise far more with the breeder of your bitch than with you - imagine how she feels now there are puppies from her carefully bred lines with a father who is unknown to her and she doesnt know where those puppies are. I would suggest you take steps to repair the damage, make a full apology and offer her all the information she may want as to the whereabouts of the puppies and who the father is. Hopefully this will go some way to mending the breach.  

To put a wider perspective on the matter which you may not have considered, and which will help you understand where the breeder is coming from.

A whole breed and it's reputaion can be ruined by careless breeding.

Most people would condemn puppy farming, mainly because of the conditions the mothers and pups are kept and reared in. 

What people often fail to understand that these people when breeding purely for financial gain are not only taking shortcuts in care and ethics of breeding, but also harm the breed by not being interested in the quality of the dogs they use for breeding. 

They don't care about their long term health (as long as the bitch can give birth and pups survive to selling age). 

They often produce substandard pups who bear only a passing resemblance to their breed, but of course the people who own them love them anyway warts and all.  They often use the excuse they are ONLY PETAS but surely a person is entitled to have a typical version of the breed they wanted, otherwise a mongrel from the dogs home would be just as suitable.

The other kind of irresponsible breeding and JUST AS HARMFUL FOR THE BREED (even though the individuals may be totally pampered and spoilt and their offspring end up in lovely homes), is what you have just done:(

You do not have the knowledge to know if the bitch or dog are good enough to produce the next generation (only about 1 in 10 are, and even in the wild only a percentage of animals get to breed). 

You do not know the health background to the parents and I am assuming have not carried out any of the recomended health tests aimed at reducing (and eventually eliminating) Genetic health problems in the breed. 

Your pups may be in good homes, but their owners knowing even less than you may also think it a nice idea to breed, and those pups may end up in rescue or even in Puppy Farms (as obviously no good breeder would sell them good stock). 

So you can see how a circle of poor breeding and poor health/temperament emerges, and guess  who gets the blame for bad examples of the breed when the reputation is ruined BREEDERS as a whole:)

As the others have said mend your relationship with the breeder, be as co-operative as you can to safeguard the pups and the breeds future.
