This has always been my advice too, Pamela - these long-winded American-style contracts that attempt to tie buyers up in knots are not a good idea in this country where the buyer is in a much more powerful position than the seller when it comes to consumer issues. I have to disagree with you about courts always favouring a good breeder regardless - my experience has been the opposite in that courts generally favour the buyer in dog-related cases (not that many cases are reported as most go via the Small Claims system) There have been several cases reported in the dog press where good breeders who have done all they could do to produce healthy puppies have lost cases brought by buyers & I know of other cases too,including those where the breeders used puppy sale contracts. Some of the decisions seem bizarre but often the breeders are not in a position to go for an appeal & so just have to grin & bear it.

Can I just add that I've wanted a GSD for about 5 years now and it's only now that I feel able to go ahead with my wishes as my oldest is now 7 and my youngest is 4 and a half- before I didn't think it was really ideal as they were still potentially babies whereas now they are old enough to know better (Maybe not;)) and can be told 'no' (providing they listen:))- they are also at School and Nursery therefore it's now ideal for me as I have a few hours to spare with one-to-one's with my puppy re training etc.
I realise it may work for others but all I'm trying to say is that this is the situation with me and personally I feel I've been quite responsable (for a change;))

Hi Jane again, I think I will make this my last reply on this subject... :-))
We are obviously watching/following different court cases. I sat in the small claims courts all around the country for 2 solid years following cases..every Thursday and Friday of every week and still sometimes go occasionally. ( addict)
For every bad decision (in my opinion only), I have seen 5000 good ones. These people are qualified.
Generally when I think there has been a wrong decision I have a better and closer look at the evidence and it becomes clearer to me why a decision has been made or there has been a material error that has affected the outcome out with the courts hands. I don't think they practice making wrong decisions.

One last thing ....
Re Puppy contracts.. I 110% agree with Westielovers screening methods ..I wished all breeders
were of WL standard and had her breeding dedication. We would certainly have happier puppies and owners. I think WL in her experince probably knows by her gut feeling about a possible owner.
I know 2 people who have just recently bought puppies from WL and are delighted with them.
I like the puppy contract suppiled by Brainless it is formal, clear but not over powering. We don't want to frighten people away.
Hopefully all these discussions help us all and I do hope none of you encounter these problems very often, in fact I hope never.
