i have recently brought a dog, Who I would like to show and possibly breed from one day, I was very selective on pedigree and as an adult dog he has real potential, only problem is on getting his Kc paperwork in the post today I find he has a breeding restriction, I contacted the previous owners who new nothing about it and were not told on the sale of this dog like myself, So where do I stand now, is it possible to lift this.

Im sure only the dogs breeder can lift this and if you contact them and they agree that your dog is a good enough specimen to be bred from then they will lift the restriction, im also sure someone with more knowledge than me will come along soon ;)

If you nor the old owners knew nothing about it then the Kennel Club should lift the ban, or if the old owners are not being 100% truthfull the Breeder should have a copy of the receipt which should state that they knew about the endorsements.

Most breeders would stipulate any restrictions in their written contract between the breeder and the new owner. I even state in mine that this puppy or dog at what ever age, will not be passed to a third party without my written consent, thus stating that a new contract would be made applicable to the new owners and myself.

Both parties sign and date the contract along with a witness to countersign.

One way of getting around the endorsements placed on dogs by their breeders is for the dog to be"sold"to a friend/family member then that person claims that they were never told & then contacts the KC & the endorsement is lifted letting them breed(it usually is breeding people are wanting to do)from the dog without health tests etc

We had this discussion some time ago and I don't think that sale to a third party is sufficient "excuse" for the KC to lift the restriction put on by the breeder.

This is why I stipulate my clause about the dog being sold to 3rd parties into my contract, so this covers this loop-hole if it should ever been needed.. MM :-)

Well it has happened recently & the bitch was bred from untested & on her second season & the puppies were registered The BRS was how the bitches breeder discovered the transfer & breeding !! When they contacted the KC they told them that the third party had purchased the dog & was not told about the endorsement so the endorsement was lifted by the KC & this was obviously planned from the outset so no Joe Bloggs involved

I would have thought a better way to stop people breeding from dogs before tests had been done & if the dogs are not to be shown was to retai the registration I sold a Beardie as a pet as he was mismarked & gave the owners a pedigree so marked & a legally drawn up document to the effect that he was not to bred from or shown in breed & if they wished to show him in obedience I required proof he had been castrated before the registration would be transferred

It worked as they tried to sell him as a show dog & stud  at 12 months & the prospectice new owners contacted me & I sent them a copy of the sale document, they still bought him & kept him as a pet & I 20 years on still have his registration

I still think that some of our knowledge should be kept to ourselves and not given freely to Joe Bloggs :(   one reason being the example that you have given.

This "loophole" has been thouroughly discussed before, and will be available to anyone who wants to do a search.  It is one of the reasons we retain the paperwork on pets pups.
