Just wondering......I know which Garden boundary fence we have to up keep, but our previous neighbours asked if thy could replace some of our fencing as it was a bit delapidated.......we agreed, these neighbours left 3 years ago, the new neighbours asked which fence they were to upkeep as they had been told by the previous neighbours that they had replaced some of our fencing, I pointed out that it was the last 5 fence panels.  At this moment the neighbours are in the process of what looks like the removal of the last 5 panels and possibley replacing them.........my question is
Do they have the right to do this as the verbal agreement/permission was with the previous neighbours?
Should they not have informed us?
Do they have the right to remove the Fence panels we erected?

The thing is we were going to replace the whole fencing this Summer anyway.

Thanx - Have been on this site earlier - I beleive they assume that as permission was given to previous neighbour that they can replace that part of the Fence - having read the info on Garden law site, the fact that they know it is our boundary, they should have consulted us and got our agreement before changing fence.  I also believe they have no right to touch the remaining Fence that we erected.
So the fencing we intend putting up wont match what they are doing now!! Hubby wont be too pleased when he gets home

Speak to them, I'm sure they don't want a missmatched fence either.  Perhaps you could come to some arrangement sharing the cost and let them do the whole job if they seem willing, always best to stay on good terms over these things. :)

just out of curiousity when facing the front of ones house, looking at the front door, from our close, i have fencing on the left and right of my house.
our house is detatched with neighbours either side.
i thought that all the fence on the right of our home was ours?
is this right facing the front of your house your responcibilities with fences and walls is on the right and the neighbours on the left have the boundary?

Not necessarily, you'll need to look at the deeds to your house.  The whole of my fence is 'shared' responsibility with my next door neighbour but my mum has sole responsibility of all of her fencing despite it bordering other properties.  I'm lucky in that my neighbours are great and (whoever is responsible) when something needs doing we share the cost.

My neighbours are better - they wanted to replace fence panels that I was responsible for so I offered to pay half the costs but they paid for the lot :D  Thanks very much :)

I might be wrong but if you know for sure that it is your fence then no one else can remove it without your permission. If they think it is on their land it is up to them to go through the due process of law to change things they cant just take it down just because you allowed a previous neighbour to repair it for you. This is just my opinion based on my commonsense as it is not my expertise in the legal work I am employed to do. If it were me I would be going ape and not allowing them to touch it AT ALL

All in all we placed a total of 15 fence panels down our boundary side  - the previous neighbours replaced the bottom 5 panels(with our permission and they paid) - it is these 5 panels that the neighbours are replacing today(although it looks more like they have just repaired the posts) Will wait to see final result.

Let us hope it is okay then. PM me if things go wrong if you would like to but I would remind them that any damage they do to your property will not be tolerated.

I agree with Joe; fences start wars.

NO idea who is responsible for our fencing but whatever needs doing we share the cost with next door whether it be front or back. And next door share the cost with next door to them too. We are on the end, so only share one boundary.

My neighbour, just after they moved in in Oct, took a shed down, left a 10' hole in the fence , and only decided to tell me 'in passing' and said, your dog wont get out will it!!!!!!!! Only had Gemma at the time. but had to go and nick some pallets off a building site 2 doors down to bloke the gapo for 2 days until they could be bothered to pout wire up
2 weeks later, they took the fence down. 100' of it. on the saturday and it took till 2 weeks later for them to put the fence back up. Ok if it was just Gemma, but I had opnly had Beano a WEEK!!!!!!!!!!!!! I had to hastely block off my patio and keep them up tyhere for 2 weeks!!!!!! Not good when you have a new 2 1/2 yo!!!!!!!!!!!!!
As you can tell, I was NOT pleased!!!!!!!!!!!!!!!!!!!!!!!
I even asked them to pout something up so that my dogs couldnt get out, but nothing. I am so pleased it is done and my dogs have free reign of garden!!!!!!!!
(Got Beano on 1st Nov. they took fence down on 7th, and was finished on 24th Nov!!!!!!!!!!!)
Now thats what you call inconsiderate!!!!!!!!!!!!!!!!!! She even has 2 dogs herself, but owns a pub so stayed there till the fence was back up!!!!!!!!!!!!

Well so far they have replaced the wooden posts with concrete ones and then put the old fence panels back up...........hubby has been watching.........if they do attempt anything with the rest of the fence we will say something as this is our property, also what is annoying is it doesn't look any better as it is uneven!  Oh well to put things in perspective worse things happen!
