Please advise who's at fault in this situation!
A seven month old puppy running free in the central park. Close by is a cycle track used at stipulated hours in the day. Cyclist in full racing gear speeding (by my standards) within the cycle lane with no sound or warning i.e. bell~knocks the puppy over and comes off the cycle slightly injured and bothered ~to say the least. No witnesses to this event ~ so where does the fault lie? Is the dog owner to blame Again!!!   Any theories?

I would guess that if the cyclist was on a designated cycle path and the dog was off lead and strayed onto it(would then be classed as out of control) it would be the dog owner at fault...but then the law is not always black and white is it.

Well if both cyclist and dog owner know that the other is likely to use the area then both should keep their eyes open just incase

I'm sorry but if its a designated cycle track you must expect cyclists to be using it and therefore should have had your puppy under control.

Tried to edit but was to late, meant to say unless he was going very fast, then I suppose it could be said that the cyclist wasn't paying due care and attention.
