Hello,
I posted a while ago regarding trying to get endorsements removed off my girls registration. The breeders of my girl are trying to blackmail me by asking for another pup etc to remove it. No contract was produced at the time of purchase and I thought that I would be ok. Anyway after sending letters to the Kennel club it seems that I have been well and truly had. They will not remove the endorsement and just suggest that I take the breeder to court. I have had all my girls health checks done and am just disgusted with the whole thing. I would never have purchased her if breeding terms had been mentioned. Any advise on what to do next would be greatly appreciated.

What was the wording of the doucument that you signed regarding the endorsements. Did it mention if and under waht circumstances it would be removed. If you just signed that you knew the pup was endorsed, I assume the KC position is that you agreed to not being able to register progeny.
In my sales contract I state that the endorsements can be lifted after good health test results and after the age of two years if the pup is a bitch.
I do think this is rather sharp practice if yoi had a verbal agreement that the endosements would be lifted.
In the long run it would probably be cheaper to let them have a puppy from the litter.
You could of course be as sneaky as them and make a verbal agreement to let them have a puppy, but then once the pups are registered and ready to go ask the full market price for it. After all you would be letting them have a puppy!!!!
Once the endorsements are off, they can go whistle, as the only person who can place endorsements is the person who owns the dog at the time.
I would hate this sort of case to undermine the endosement procedure, as it really is the only slight safeguard the breeder has over their pups being breed from willy nilly.

Hi, Thank-you for your reply. There was no contract. It wasn't until I got to the breeders to collect her that I noticed the endorsement ( after a 6 hour car journey) They never mentioned the fact before then even knowing that I wished to show and breed. Then when it was questioned he said that it was just something that he did as routine and that he would remove it as soon as she had her health checks done.In fact at the time the man even tried to sell me a stud dog who would tie in nicely with her! I really do not want one of my pups to go to this man and would rather not breed a litter at all ( or just not register the pups) then let him take one of my babies.

How old is your bitch, as it is only in the last few years that the kennel club require the breeder to get the new owner to sign their accptance of the endorsments, as I assume they have had a few cases like yours. Now the endorsements can be lifted if there is no agreement, or if the terms of the agreement have been fulfilled.
Does this mean you have an older bitch, and that is why the KC were unable to help you. I know that in some breeds such a strangle hold on stock is common, and breeding terms arrangements that weigh heavily in the original breeders favour seem common. I am curious to know if yours is the breed I am thinking it might be in which there are a few breeders who tie up bitch puppy owners in this way.

My understanding is that if the dog has a restriction then a contract has to be signed to say that you agree with it. Just because the KC papers had it on how can the breeder vouch to say that this was mentioned/agreed. I as a breeder had no rights (restrictions) unless I can produce a document signed by the new owners saying they agree to the terms. Try contacting the KC again - I had to provide the contract to the KC to prevent it's removal from a bitch who the owners were wanting to breed with. Try them again - but write dont phone found out that I got a more acurate reply that way ! Good Luck

My bitch is a dobermann and she is 20 months old. I also thought that a contract had to be signed for it to be valid but that seems to not be the case. The kennel club have just said that because I knew that the endorsement was in place at the time of purchase then tough luck! These breeders obviously do this on a regular basis and register a huge number of pups under different affix's ( so I've just found out)

I would agree with Brainless, and just agree to them having a pup, and then when it comes time, tell them it is full price. I doubt they will want one as much any more. Sorry I can't help more, :(.

You mentioned that you wanted to show and breed. Have you ever shown your girl? If you did this and started to do well you could just let set slip around the ring that you would love to breed from her but her breeders are not being straight with you so you can't.
Did you pay all the money up front (buy before you got there) or pay when you picked her up. At what point were you aware that the registration was endorsed - before or after parting with the cash?
There are distinct benefits to not breeding - no risk to the bitch, no phone calls late at night from a pub when someone has seen your pups advertised somewhere, no untrained monsters coming back at adolescence - just when you were planning a few days away for the first time in years, etc etc :)

PS Folks, Debbie is one of the few, if not the only, Dobermann owner(s) on this board to have taken advantage of the vWD Clinics and had her bitch tested.

Yep there is nothing like looking bad in front of your peers to make you tow the accepted line :D

Unfortunately I have never shown Taz. I don't know if you remember but a couple of weeks after I got her home she grew a white chest! Luckily this has almost disappeared now with just a few stray hairs. So I could give it a go.
I had already paid a £100 deposit and I was even stupid enough to send an extra £25 as they were kind enough to let me have pick of litter. ( How stupid am I) Once I'd arrived there and spent a couple of hours choosing Taz we then took her indoors to sort out the paperwork which is when I noticed the endorsement. They were just so relaxed and nice about it I really trusted them. Even saying that they had been stitched up in the past and now placed the endorsement as routine ( what a joke). I will not be blackmailed by these people and they are not having one of my babies ( mind you when they saw their tails they may have a rethink anyway). I feel like such an idiot. I've now sent another letter to the breeder saying that I am willing to let them have a pup at a reduced price( I think £995.95 would be reasonable) but that is all.

Hi Everyone,
I just thought I'd share my great news with you. The breeders have agreed to remove the endorsement. They have sent me a letter which I have now sent on to the Kennel Club, with any luck I can breed a litter from my girl in the spring. I'm sooo excited.

Strangely they haven't requested anything in return although they would still be interested in a puppy. I was sure that I was going to have to take legal action. I'm so pleased that it hasn't gone that far.

Congratulations, theres nothing worse then greedy breeders that dont give a rats about there puppies and just wont the money or a puppy so they can keep on breeding....... good on you for not letting them get away with it.
