Topic Dog Boards / Visitors Questions / KC Lift Restrictions?
- By guest [gb] Date 18.07.03 10:13 UTC
I have been assured by some friends of mine that The Kennel Club will lift restrictions on your dogs if their health screening tests are acceptable. I don't know were they get this information from but I'm pretty sure that this can't be done, or can it? Are they correct in saying that you can now pass the breeder who placed the restrictions on in the first place, for good reasons and get The Kennel Club to do this. If so it seems unfair to the breeder. Please tell me this isn't true and I can put my friends straight.
Thankyou, Sam.

I've heard of restriction being removed years ago that hadn't gone through the breeder. Usually though these days the breeder has to sign a letter saying that it is OK to.

It will depend a good deal on the written agreement with the breeder. If there was nothing in writing then the KC may consider lifting the ban. They will write to the breeder and ask if they can see any paper work that was signed by the puppy buyer to say they understood the restrictions.

Based on my own experience the Kc will not remove endorsements even if you have had all health checks done. If you wish to breed from your dog make sure that you get a written contract from the breeder when you purchase the puppy saying that the endorsements will be removed if health checks are satisfactory.

If a breeder had put restrictions on a puppy and the puppy buyer has agreed to them then the KC should never remove them without the breeder’s permission, otherwise what is the point of endorsements? Whether health screening has been carried out or not ONLY the breeder has the authority to remove them.

"the KC should never remove them without the breeder’s permission"

Sadly, the KC do not appear to see it that way. I am hearing of more and more endorsements being over turned.

This is true Admin. The KC removed one on export which a friend had put on! There was no justification and sooner or later I suspect someone is going to resort to law. Endorsements are put there for a reason.

Hi all

i have a question to do with restrictions,

some one i no bought a bitch, no restrictins on kc form, after 12 mths of age had this bitch hip scored, the bitch was 3-4, she later bred this bitch at 2 half years old, the breeder found out the bitch had been bred, and didnt like it so she rang kennel club, and when the lady went to reg her litter endorsments had been put on the bitch only days before, she rang kc and was told breeder had made mistake and they should have been put on when she reg the the bitch. Any one else had this prob would love to hear about it!!!!!!!!!

I have contacted the KC in the past about this. A breeder can only put restrictions on a dog they bred if they are in possession of the dog and it is registered in their name. So I would get your firend to contact the KC again and get the restrictions removed with immeditae effect. It is the breeders fault if they failed to put the endorsements on at the time.

HI Guest,

I may be wrong but I find this hard to believe, if it is true it is probably ilegal.

Mistake or not if the breeder registers them and then sells with the unendorsed paperwork, they cannot a year or 2 later change it.

I know the KC get it weong but this would be a big boo boo..

Is there no way that you freind did have the endorsement on it and thought she didn't? Sounds very strange and woul doubt if common.

The litter registration form says quite clearly that endorsements can only be put on at the time that the dog is in the breeders mownership. Because there have been problems over endorsements, for some years now the Kennel Club have advised that the breeder should get a signature on something in writing about the endorsements, so that the new owner cannot later claim they were unaware.

Could it be that your freind did not transfer the bitch into their name (I find going through the BRS info that only around half of my pups new owners ever bother with the transfers), and when they belatedly did, they found the endosement to be in place?

If not, and it is as you say contact the KC to inform them that they have made a mistake.

I asked the KC last year to remove endosements from four of my breeding (my own Champion bitch, her intended suitor, and two other bitches who have been shown and are going to be bred from, after they had good health test results). I had it confirmed that these were lifted.

One of the new breeders applied to have her new affix added to her bitch's name before her litter were born, and her papers came back with the addition, and the endosement back on!!!

I contacted the KC and a mistake had occured when someone had not checked tha the endorsement had been lifted when changing the bitch's registered name.

Mistakes do happen!
