Topic Dog Boards / General / Being stitch up by breeder, HELP!
- By Jewel [gb] Date 22.05.03 09:42 UTC
Hello,

I have a beautiful bitch who I intend to breed when she is 2. She is KC reg and has had all the relevant health tests for her breed. When I purchased her I noticed that her Registration had endorsements in place for breeding ( after a 5 hour car journey) After speaking with the breeder he assured me that the endorsements could be removed if I just contacted him before I had her mated. There was no contract etc stating the endorsement. I have had my girl hipscored , Vwd DNA tested and she will be eye tested clear before being mated. However having just spoke to her breeder I am 'FURIOUS' He will not remove the endorsement unless I use the stud dog of his choice at my expense and give him pick of litter!!!!!! I just feel that I am being ripped off. I am breeding this litter to hopefully keep a puppy to show so obviously him having pick of litter is out of the question and to be honest I really would be heartbroken if I had to send any of my babies to this man.
I have just spoke to the Kennel Club and I've got to send them a letter to try and get the endorsements removed this way but what if they won't remove it??? Then I always run the risk of annoying the breeder by attempting this and not getting it removed at all.
Sorry to rant and rave I just cannot believe the nerve of some people!!
Any advise would be greatly appreciated.

Debbie

So far as I am aware unless you have signed a contract saying that you knew the endorsements were in place when you bought the puppy, then the Kennel Club will lift the endorsement without the breeders permission.

I wouldn't worry one little bit about upsetting this breeder, they are trying to rip you off in my opinion. If they had wanted to sell the bitch on breeding terms then this should have been set out in a contract and you made aware of it.

If he wants a puppy from your bitch when you have them, then he should pay the market price, or if he was behaving decently possibly a puppy at a discount price, to continue his lines.
In no way should he have pick of the litter.

It might help the situation if you explain all this to the breeder, about the fact that he should have informed you in writing about the endorsements, etc, It may just change his mind.

Hi Debbie,

Sorry to hear what has happened to you :( Is this your Dobe bitch? I can't help but it has definitely been a warning to me. As you may remember, I am in the process of searching for a Dobe, I need to take care. Can you email me the name of the breeder in case I come upon the same one. I hope you find a solution.

Good Luck :)

Lady dazzle is correct unless you have signed a agreement to say you are aware of the breeding restriction and agree to it the endorsement shoud be void.
a lot of good breeders endorse pedigrees but they always make the prospective owners aware of any endorsement or breeding terms attatched to the puppy
Good luck and I hope you get a favourable outcome

Thank-you for your replies. Yes it is my Dobe 'Taz'. I will send my letter to the Kennel Club and see what happens. Another thought though 'He' would also want the puppy docked and I have no intention of chopping off my babies tails. In all honesty I would rather breed an unregistered litter then let him get his way!!!

Thanks again

Debbie

All are correct about the NEW rule on endorsements not being valid unless new owner has signed that they are aware of them, only slight sticking point is that this rule was not in place when you bought your puppy. However, hopefully the KC will still help and the same conditions will apply, fingers crossed that all goes well for you and you are free to choose your own stud dog, etc.

Just out of interest when did the rule come into force?

Ooh, no good at questions like that, time flies ......... end of last year/beginning of this year?? Think they have recognised it as a problem though, so would suspect that you will find the KC sympathetic to your cause, particularly as you've been so conscientious with health tests.

The rule was in place when I bred a litter nearly two years ago! So will definately apply in this case. The rule was brought in, and breeders were sent a slip with their registrations to point out that they needed to get the new owners signature showing they were aware of the endorsements, this was because of cases of dispute between owner and breeder being put before the KC.

Good news, Debbie should have no problems then :D - unusual example of KC doing something unquestionably useful! Maybe they're just publicising it a lot recently as people weren't aware and they're still getting problems.
