Hi,
We bought a Cavalier King Charles puppy from a breeder 6 weeks ago, the breeder assured us that the KC registration papers would follow shortly afterwards. We have now been contacted by the breeder to say that they are unable to obtain KC registration as the mother was bred 2 day's before her first birthday. As you can imagine we are somewhat aggrieved since we believed we paid (a not inconsiderable sum) for a pedigree dog.
Has anyone come across this situation before and what would you advise?

although i havent personally been in this situation and the excuse they have given is a poor one .
Any decent and experienced breeder would know the correct date to breed from . Puppies can be registered straight away so there fore if you bought your pup at seven /eight weeks old they would already have had some info back from the Kennel Club .
I would say it is a lame excuse and they knew all along . Did you see for yourselves that the mother and father were kc registered in the first place ?
I am unsure what redress you would have in this case but good luck anyway

Hi, under the Breeding and sale of Dogs (Welfare) Act 1999 licensing laws for both domestic and non domestic breeders under Health and Welfare of the breeding bitch 6.1 Mating - That bitches are not mated if they are less than 1 year old.
This is the reason why the Kennel Club would not register the litter.

Hi, if the breeder advertised the litter of puppies for sale as KC registered and was not in possession of the KC registration documentation at the time then that is against the Trades Description Act and you should contact your local Trading Standards office. The breeder to cover herself should have written on the advertisement that 'KC registration applied for'. I think it is advisable to contact T/S in any event as you presumed/thought that you were purchasing a KC reg puppy and due to the circumstances in my other message the breeder was possibly not aware of the up to date legislation in respect of dog breeding.

How disgusting anyone who breeds dogs must be aware of the twelve month rule after all its common knowledge! any way 12 months is a litttle young i think but im not a expert on cavaliers ??
You should be entitled to a partial refund or to return the puppy for a full refund but i guess youve fallen in love by now (probaly what the breeder counted on)
unless you want to breed or show the papers aren`t a must but the breeder is in the wrong and I understand you must be very upset its another clear case for doing your research before buying a puppy!!

Not everyone really cares about these rules and are just in it for money.
A lady who i met at a show who has toy breeds says that she always breeds on the first season and the bitches bones are still soft and it is easier to give birth for the first time.
And has been doing it for 30 years and never had a problem in all that time.
She must be the only person i have ever met that has never had a problem.
Not everyone is concerned about the dogs that they use and abuse!!
