I am hoping somebody can help me I bought my dog from a breeder online via champdogs- when I purchased her I told the breeder I wanted to breed from she said this was fine but did tell me there would be 2 endorsements on her file that would be removed when her health tests were done well now the tests have been done she has said she will not be lifting these. I feel cheated and don’t know what to do, I would consider anything even legal advice at this stage.  Any help is greatly appreciated.

Ps she decided without seeing the dog or the health tests.  Purely because we had a falling out.

If the contract stated under what circumstances the endorsements would be lifted e.g suitable health test results, then I would approach the KC however there is no guarantee they would intercede

Endorsements:  Endorsements are a minefield of debate & legalities from what I have learn't on this Forum only recently.  Point 1. If the Breeder has placed endorsements you should have a copy of the letter from the KC confirming they have been implemented (normally found within your Puppy Pack given at time of collection).  This means you have it in writing and not just the Breeders spoken word that such an agreement exists. 2.  If you signed a Contract of Sale that included written confirmation you were aware of them that means you agreed to the Endorsements including the terms of which the endorsements would be lifted.  3. Endorsements stop you registering a Litter as Pedigree Puppies but does not stop you from Breeding a Litter. 4. I suspect this 'falling out' with your Breeder has allowed him/her the opportunity to make things difficult for you but moving forward - check these endorsements have actually been placed as they can only be validated by the Breeder whilst in his/her ownership and if so, maybe do a bit of humble pie sharing? 5.  If you find there are no Endorsements quickly make sure you have the 'change of ownership' confirmation or make 'change of ownership'  immediately online with the Kennel Club and Endorsements can then not be made retrospectively.  Good Luck!

There's no such thing. Endorsements are printed on the registration certificate.

That's not possible either -the buyer must be informed before taking the pup home. The breeder can't put endorsements on pups not in their physical possession, and for endorsements to stand the buyer must sign to say they have been made aware.

Goldmali:;  The OP was concerned that the Breeder wouldn't lift endorsements she said she'd placed. I suggested it would be wise to check they had placed endorsements as a letter would need to be sent & confirmation received from the KC and the new owner made aware of the retrospective application by the Breeder if they were not placed on the original paperwork therefor maybe none had been placed to start with meaning she could legally challenge the Breeder..  Your comment is exactly what I explained that the Breeder cannot do this if the dog is no longer in their posession .. we are arguing the same point of view.

All they need to do is look at the KC reg certificate when they bought pup home.

The endorsements are clearly shown.

Knowing they are.lifted less easy unless you ask for a new copy of reg cert, as confirmation of lifting is only sent to the person placing it, and NOT TO THE OWNER.

This is why I always send a copy of the letter I send to KC when asking them to lift.

More than once I have asked the KC, why oh why don't you inform the OWNER!!

I am now in the position that I can't remember if I have removed the endorsements on a bitch I am hoping to have a pup from.

I have also twice in the past forgotten to lift endorsements on my own bitches, and been contacted by KC, telling me my Puppy Registrations could not be processed until I did so, duh

Was there anything you signed which had these conditions stated (that she would lift them if you completed health testing?)? These conditions need to be specified in a contract which you both sign to agree you've seen. If you have a signed contract specifying the conditions under which the endorsements would be lifted, then you can take that to the KC along with evidence you've met the requirements and ask them to override and lift the endorsements.

Unfortunately if you didn't sign a contract with the conditions specified for lifting them, then it's entirely down to her discretion whether to lift them or not.

Though if they didn't have you sign that the endorsements were placed, showing you knew they were there, then KC would lift them, as they have to be properly placed.

That's true too. Sassy, did you sign a contract and what did it say?

The contract which I signed said she would lift the endorsements if I did the tests required by kc which were done as requested  but now she has decided not to lift them - all completed tests are visible on kc.

I would think you have a good case to take to the KC for getting the endorsements lifted. I would suggest getting copies of all the paperwork together and sending it to them - assuming they've time to look at it in and amongst sorting out the total b@lls up they've made of their website

Excellent, so send a copy of your signed contract and the conditions and also your health test results and send that to the KC by email. Call them to find out the best email to use for it...
