has any one know of or have a breeding contract,not a puppy sale one,one where you are in agreement or joint owner of a bitch on breeding grounds and showing/working

just to know if it works,and what on the agreement,.

Years ago I had a breeding contract drafted by the KC for a Kerry Blue bitch that I didn't want to lose the lines of.
Total disaster - the new owners vanished off the face of the earth and left no forwarding address ever, and ing spite of all my homework I never did find out where they or the little bitch ended up. I was gutted.

Hi Briedog, I have two bitches, each on different breeding terms. However neither is in writing, only verbal. I guess I'm trusted!!!
Bitch 1, Terms apply to the first litter only. I paid only half price for the bitch in the first place. My breeder is to nominate the stud dog to be used to sire the litter. I meet all day to day costs, and breeding costs. My breeder selects from the litter 1st and 3rd pick, leaving me with 2nd and whatever else. If only 1 pup is born, he gets it, if only 2 pups, then we get one each.

Bitch 2, was given to me, no money changed hands. She is registered in joint names. When it comes time to breed from her, then she'll be transferred back into her breeders name, and the litter will bear his affix. I will have no responsibility for her litter, but I will be given a puppy of the breeders choice, from the litter.

I can see the sense in getting this in writing though.

I have a dog on breeding terms stating that he could be used free of charge at stud by them if they wanted to. He is held in joint names at my address with both our affixes on. However, it was his breeder that has moved and I have subsequently had him castrated!

Hi Bec, The way you have worded your post makes it sound as though you had the dog castrated without the partners knowledge or agreement. If that is the case, then it is incidents like this that make most people wary of 'breeding terms'. The thought that partners cannot be trusted!! If I have got the wrong end of the stick then I apologise, but that's the way it appears.

I entered into an agreement a while ago. The bitch was jointly owned and I was obligated to have her bred with a stud dog of her breeder's approval. I was only allowed to keep one puppy (second pick after the breeder, if the breeder wanted to keep a puppy) from the first litter. After she had a litter (or proved she could not) then full ownership transferred to me. This was acceptable to me because the breeder spent a lot of her time teaching me the ropes and her husband handled my bitch on occassion as well.

What annoyed me is that the stud dog I used was the breeder's dog and she charged me a stud fee. It was just not something I thought about, the breeder suggested I used her dog, and I guess since I had a right to only one puppy I thought it was a bit of a cheek. In retrospect, stud fee should have been spelled out in the contract in terms of who pays and at least I would have known in advance.
