Hi I brought a dog off my auntie, I've had he for over a year and still have no papers.
She brought him as a puppy, but because he was a pound bigger than her breeding program
she decide to sale him. We had no written contract or agreements. She said she would only give me the papers
If I allow her to use him as a stud for her for free because I brought he cheaper than she paid he was also nearly a year old when I got him. Just looking for advice how and if can get papers. And now I am getting him neutered.
She claims its in breeders rights that she can use him when she likes. Any advice welcome thanks

Why on earth would she want to use him if she had already decided he wasn't good enough? If you've bought the dog he is legally yours and without any contract of any sort, she has no rights at all. You can go ahead and neuter him and enjoy him as a pet -his papers won't matter to you then anyway.
You only really need the papers if you intend to show or breed. If you are going to get him neutered then I wouldn't bother about getting them.
You cannot get KC papers yourself, the breeder has them, then will transfer to the puppies owner who will send them off to the KC to transfer to them. The papers should have been transfered to you at the time of sale as the dog is now yours, (a one year old dog unless it is gundog trained or a show champion, will sell for approx a quarter of the original price, so of course you should have paid a cheaper price, that was not a favour.)
However, if you made an agreement with your Auntie that the dog is to be used as a stud dog if a good example of the breed and the papers are to be held until that time, I don't understand why you are now backing out, only you know what you agreed to and if holding onto the papers to make sure you did that was your Aunties way of making sure she got to use the dog, I guess she knew you might back out as you are. Seems a mean thing to do to your Aunty if that is what was agreed.
However, without a signed contract she cannot enforce it and legally she needs to give you the KC papers as long as you can prove that you actually did purchase the dog, a bank statement, cheque etc. I would never screw over my family though, so I would think long and hard before you cause a rift.

She has no "breeder's"rights unless 1 she bred him & 2. you have a written contract neither of which applies here so get him neutered & then she cannot produce any expensive designer mongrels
because she wants to breed him with a different breed. Then she is no better than a puppy farmer and you should definitely not agree!

Get him neutered quick!
You won't need any "papers" and your Auntie will stop being interested in him overnight :-)

Ok hun, if nothing was agreed at the time of purchase she has no rights morally or otherwise then, there are no breeding rights apart from the ones she has in her head, which you quite rightly can decline as the dog is now yours, your Aunt gave all of her rights away when you bought him without a contract or verbal agreement (which people tend to go back on) you are free to do whatever you wish with your dog....... and no wonder you want to have him neutered pronto.
As this is family I still would try to talk to your Aunt nicely about this, tell her you do not wish to breed your dog and legally she needs to give you the papers, although as has been said they are not important if you do not wish to show or breed, but I still would want them too as they are yours. :-)
The reason I asked if you had proof of purchase is a breeder or previous owner should give a bill of sale especially if no papers are with the dog, not wishing to worry you but sometimes people can be nasty and if you do not have that bill of sale, hopefully you have proof of purchase incase things turn nasty and she says you are just looking after the dog and did not buy it, you should have vet bills, insurance, microchip details etc to also back up yourself as his owner, as she has not transfered the dog to you paper wise. Hopefully, it will not be needed, but just in case, cover yourself. :-)
And the quicker you neuter the better, hopefully she will then relent and pass on your papers as they are useless to her, (unless she is planning on using them for another dog gulp!) Make sure you get them!
