Our neighbour has a row of trees planted approx 1 meter from the wall of our home, now apart from what the roots are doing to the foundations we have a problem with the overhang.

These trees now touch the wall and roof of our property and what I want to know is can I insist that he cuts and removes the offending branches, we would do it ourselves but as it is his property and we would have to pay someone to do it we are reluctant so how do we stand in law

Thanks JG interesting, these trees are within 1 meter and some are evergreen.

We are stressed about it because my OH is 82 so I don't see why he should get up a ladder with a chain saw, remove the branches and then try to return them over to our neighbours side of the boundary where his tenants leave their cars, if one of the cars gets damaged we will have the problem but if we get a tree surgeon in I guess we are looking at about £1000 ever year and that is not fair on us either.

Not read the link but I understand any overhang can be cut by you, as long as you let him have what you have cut off back!!

just a quick. reply as on my phone at work but if they are beside your house wall ring your insurance company and ask advice. as it might undermine your foundations depending on the size and type
