I bought a four month old puppy only a week ago and paid quite a bit for him.I'd been searching for one for ages and I definately chose the best one. He's so well behaved and loving.I didn't think I'd need a receipt when I bought him.I had such a shock when I found out that, now, they want him back!!!They can't do this, can they?! He's ours now and settled in here from day one. He's the best thing we ever did. There is no way we'd ever give him up!They said they made the wrong decision in giving him up,which they did so because they both now work full time which we don't;he's only on his own for about 2 hours in the mornning, where as they would've had to leave him all day. The're children didn't even know that he was being sold!I'm SO angry. What if they come looking for him..?They don't know my address, but know my name & the town I live in.I really don't know if anyone else has been in the same situation but,if so,please help!I love my "little boy" unconditionaly.

is the dog kc registered-if so did you get a form from them , if you did then youd have proof it was sold to you, other than that im not sure-was it advertised anywhere, if it was get a copy of it, then it would help prove they wanted to move the dog on

You do need some professional advice on this. How did you find out he was for sale? How did you pay for him?You need to gather all the information together
you can.Meantime if they contact you again, just tell them the matter is closed, tell them it is not your fault they did not give the matter due thought before putting the dog up for sale that you bought it in good faith and to please not contact you again.
This might do the trick but please do take advice just in case they persist then you will know where you stand and meantime don`t let the puppy out of your site.
Good Luck

I ditto what Carole said for just now keep the dog in site at all times. Don't give out your
address.
Strange people they didn't even take your address to check up on the puppy.
Don't worry too much about proving you bought the dog just now you find this happens quite a lot and should quieten down.
Pam

Did you pay by cheque? If you did and they have cashed it then the puppy is your property. If you paid by cash then I would imagine THEY would have to satisfy a court as to WHY they let you take the pup in the first place.
A dog is property when alls said and done , no matter how much we love them , and if you pay for something and take it home the law will be on your side. If these people harass you , go to the police.
As someone else says , tell them , if they find you , the matter is closed and then shut the door.

Guest,
You do not need a reciept.
You bought the dog , so the dog is yours end of story.
Unfortunalty most of the time we don't like to see dogs viewed as a purchased item but as time like these with your situation this is where is understandable why there are.
The dogs is yours basically end of story.
Was the dog KC reg by chance?

Hi Guest,
you say they do not know where you live, but how do you know they want the dog back! Sorry if I am a bit unsure,

its just that I find it very strange that they sold this dog on without you providing them with you details, and that you have paid out this money with out getting some kind of proof you are now the new owner ie: KC Reg or receipt. Were you provided with a pedigree for the dog? I would strongly recomend you seek legal advice about this straight away.
Good Luck!!!
Best Wishes

Hi Guest
I am so sorry you are going through this, I just thought that I would reply as, like you, I have just purchased my dog from someone who couldn't cope with her anymore, I asked the lady to sign over her Kennel Club Registration to me, (theres a part the owner has to sign to change ownership) , also I asked for a receipt, and because she was microchipped the lady also signed over the microchip form to my name aswell..I hope this may be of some help because if you have either a KC form or a microchip form signed over to you I am sure this must prove ownership to you...But I am no expert.
I really wish you all the best, the previous owner of my dog keeps in contact with us and we with her and we will arrange to visit her or her visit us sometime in the future as I know it must be a very hard thing to decide, to rehome your dog.
I really felt or you becasue it would break my heart if that happened to me.please let us know how you get on :)
Wishing you well

I have been speaking to KC about another query regarding 'legal ownership' as far as they are concerned the KC reg is proof. The microchip only prives it is chipped and is for id purpose not proof of owner
Sorry I may be wrong here but I can't belive a reputable breeder would let a pup go without a contact address.I take name ,address ,tel no and E-mail off mine before I let them go.
Plus possession is 9 10ths of the law is'nt it
By Lynsey
Date 10.01.03 12:36 UTC
yes I wasn't saying the chip was proof, however if the previous owner had signed over ownership of the dog on this microchip form to the new owner that would be proof of purchase, or IMO anyways

HI Star and everyone else,
The form maybe in the KC eyes show the ownership and I think they mean by this as far as they are concerned only, not legally.
legally the form on it's OWN doe's not prove who is the legal owner. I am confident about this.
Your Log book with you car which is the registration document has the owners name on it "generally" but it clearly states on the back that the registered keeper is not necessary the legal owner.
These registration forms of any kind are only 100% proof of ownership when backed up by something else such as receipt, witnesses of payment.
Sorry to keep pointing out the legal iregularities but I would not like to think people read somethings and then think that they are 100% right as they are sometimes not. I am no way saying I am 100% right either but I always say don't believe all you hear.

Hi all
GUEST i do not wish to offend and i am sure you are looking arfter the puppy well
But as you all know should you think for any reason that a puppy you had bred was not being looked arfter would you not try to get the puppy back,
Maybe the breeder has been lead to belive this is the case possibly by a second party,
As the guest states that this was the best pup in the litter so other puppys must of been sold by this person why do they want this one back?
Guest you said that you work two hours a day could she of phoned and been told you were at work leaveing her to think that you work full time hence the puppy is being left all day on its own.
maybe this is all just a mistake,
sandy.

Sandy
I gathered from reading this guests post that the people who had sold her the pup, were the original buyers from the breeder.
Unless I am not understanding the post, I don't actually think its the breeder who is after the pup.

By the sounds of it the previous owners dont even deserve to have A dog never mind your dog back !!! :(
How can you sell a dog and then change your mind - its a decision they should have thought long and hard about before they offered the dog to yourselves - and as for not even telling their children !!!!!
I would agree with the above posts re; kc registration and also if you paid by cheque you have proof anyway .
Hope all goes well for you and pup . :)

They formed a verbal contract with you the day they sold you the dog, it is binding. Even more so if cash/cheque was handed over.
How did they advertise the dog for sale? If it was a notice in a shop window or a newspaper clipping, then dig it out and hang onto it. It may be necessary if things get nasty.
Speak with a solicitor who deals in civil law if needs be. Make a note of the date you found out it was for sale and why it was for sale - and then the date you bought the pup and what they said to you at the time. The contract will hold but this extra evidence will help.
Good luck

Hi
Just to say...Ownership of a dog has nothing to do with the Kennel club..the KC is an organisation that you may or may not join enabling you to compete in KC organised events.
A dogs owner is defined by who pays for its food and who covers the vets bills.
You paid for your baby, you love your baby and obviously pay for everything needed. You are the owner.
Someone cannot just decide to take a dog back. You are the innocent party in the eyes of the law..if you didn't get a receipt it makes no difference..if they say you didn't buy the dog they have to prove you stole it..which of course you didn't. 'Innocent until proven guilty'
Stick to your guns you are under no obligation to return the dog and make that very clear to these people.
Take care and love your baby boy to bits :)
this same thing has just happened to me an old lady (84) with a 5 month old puppy advertised him for rehoming. We went one week and said that we would like to have him but wanted her to make sure it was the right thing to do and gave her a week to consider it, she was still happy to go ahead and we gave over cash for him and now she is ringing saying that she is missing him only a week after we picked him up. I will not let him go as he is now a big part of the family so I just wanted to check if anyone new what happened in this case. I am sure I am in the right

The puppy is yours, trying to get it back is like a shop coming to you & asking for their goods back after you have paid for them

If it is the elderly lady, why don't you send her a few photographs - she may be lonely - but there again, she could be trying it on - you have to go on your instincts - but you have paid for the puppy (did you get a receipt?), so it is definitely yours now!

Don't worry - they sold you the pup and you paid for him - end of story - they may huff and puff but they gave up any legal rights to YOUR puppy once they accepted your cash.
If they do, by any misfortune, try and take him then they would be guilty of stealing your property ( but I would advise that you keep him in sight for a little while yet :)). Do not be intimidated by these people - rest assured that they have NO legal rights to your puppy and calmly inform them of these facts and insist that they cease their harrassment of you.
Enjoy your new wee friend :D
