a friend of mine has just mated her bitch. The bitch is endorsed.  Her breeder knew my friend wanted to breed from her as it was discussed when she first went to see the litter. My friend was not told the bitch was endorsed when she bought her and did not sign a contract. She only found out the bitch was endorsed when the papers arrived a couple of weeks later. She didn't get them with the pup as there was a hold up with the KC name.
Before mating the bitch my friend tried to contact the breeder and left several messages for her but she never replied to them so my friend went ahead and mated the bitch. She has finally received a message from the breeder saying that she will not lift the endorsement and the bitch was not sold for breeding from. My friend is worried sick now as she has several people wanting pups to show from this girl so needs to be able to register them.
I have said that as she never signed a contract and was not told about the endorsement then the KC should lift it. Is this correct? thanks

Yes for the breeder to be able to prevent the KC lifting it they have to have it in writing that the buyer understood they were buying an endorsed puppy. However I do think your friend should have got this sorted BEFORE going ahead with the mating if they didn't know this for a fact...

Has your friend had all the manditory health tests done on the bitch and the stud with good results, if not then the KC may not over turn the endorsement. I personally would not have mated a dog I didn't have the all clear on, there are plenty of unregistered pups out there already.

Many endorsements are put in place by the breeder till all the health checks have been done and got good results before they are then lifted, some may also want the dog to have proved itself in the ring or be evaluated by someone well respected in the breed.

An endorsement may have been applied because there is a major problem with one pup in the litter which may be carried by the rest making it very important that the endorsed pups are not bred from.

I think your friend should have contacted the KC as soon as she saw the endorsements on her papers. and found out then where she stood.

going back acouple of year a friend had the same problem (not my breed) no contract signed she contacted the kc and as no signed contract and the puppy was not in the breeders possesion when registered the kc did lift the restrictions , they did contact the breeder to provide written proof of contract but as the breeder could not supply it the lifted them.
Have to agree tho  the bitch was'nt mated until enorsements were lifted.

I hadn't thought of that but yes as the registration did not take place until after the pup was bought then it does  sound like she has a good case.

And yes the bitch has had all health tests. She is successfully shown. My friend has been trying to contact the breeder for some time to try to get the endorsement lifted with no response from the breeder. The bitch then came into season so my friend had to make a decision whether to go ahead with the long planned mating or whether to wait for another season. As the bitch had 9 months between this season and the last she was reluctant to miss this season so went ahead with the mating only for the breeder to suddenly email to say she would not  lift the endorsement with no explanation.

If the breeder is unable to provide the KC with a contract signed by current owner stating that they fully understood the conditions of the endorsement before the puppy left their possession then the KC will lift them as they have been applied incorrectly.

I read that the pups were registered before they left the breeders but due to a registered name choice the paper work had been held up, not that the breeder left the registration of the litter till after they were rehomed.

Don't think in this case when the registration took place has any bearing on the matter. The KC expect the puppy purchaser to be made fully aware that the pup is endorsed and what that means, I believe they also require the purchasers signature to confirm this. If this was not done then the KC should lift the endorsement and any other matters such as the registration or the mating of the bitch will not or should not make any difference. I would however get onto the matter straight away as it may take time to sort.

It can take 3 or 4 months for the Endorsements to be lifted especially if the Breeder refutes it.

It would normally be the breeder that asks for it to be lifted and then it takes just days.

But this being a disputed case it will take some time.
