- By Lea Date 05.04.11 21:46 UTC
Where is fox hunting legal????????? Is Wales and Scotland still allowed??
Is it allowed in other countries??
Just curious after talking to a long time farmer and a long time allotment owner today.

England & Wales are both covered by the Hunting Act 2004.
Scotland is covered by The Protection of Wild Mammals (Scotland) Act 2002

So it is still banned in Scotland????
How can all 3 have different rules on different things?

Welllll... it is actually legal in Scotland to flush a fox out of cover, and if the dog accidently kills the fox that's ok too (the fox wouldn't agree!), as long as you have the land owners permission and you are doing it to protect livestock etc. You can't chase after the fox for hours on horseback, it should be shot as soon as possible.

So in Scotland it is still legal for the people that did the job properly??? Flushed the fox out with the dogs and the fox is killed quickly in line with the law, whether it be by the foxes or by the gun??? They should never have gone on land theyy were not allowed, and they should never have chased a fox for hours on end.
But it is still illegal in britain, So if I asked on here for a hunt to come and kill foxes on my land with dogs then I would be wrong because there is only Scotland that it is legal with restraints??? so we should not be advocating it on a UK site??????

(UK meaning England Ireland Scotland Wales)

I'm not familiar with the english law, so I looked it up and the same rules seem to apply. You can use a dog, not more than 2 at a time, to flush a fox, or below ground to locate a fox as long as..

The first condition is that the stalking or flushing out is undertaken for the purpose of preventing or reducing serious damage to game birds or wild birds (within the meaning of section 27 of the Wildlife and Countryside Act 1981 (c. 69)) which a person is keeping or preserving for the purpose of their being shot.

(3)The second condition is that the person doing the stalking or flushing out--

(a)has with him written evidence--

(i)that the land on which the stalking or flushing out takes place belongs to him, or

(ii)that he has been given permission to use that land for the purpose by the occupier or, in the case of unoccupied land, by a person to whom it belongs, and

(b)makes the evidence immediately available for inspection by a constable who asks to see it.

(4)The third condition is that the stalking or flushing out does not involve the use of more than one dog below ground at any one time.

(5)In so far as stalking or flushing out is undertaken with the use of a dog below ground in accordance with this paragraph, paragraph 1 shall have effect as if for the condition in paragraph 1(7) there were substituted the condition that--

(a)reasonable steps are taken for the purpose of ensuring that as soon as possible after being found the wild mammal is flushed out from below ground,

(b)reasonable steps are taken for the purpose of ensuring that as soon as possible after being flushed out from below ground the wild mammal is shot dead by a competent person,

Pretty similar to the law in Scotland. I guess then that there is no harm in asking for help to get rid of them.

So a single dog, or 2 dogs can flush vermin out but more than that it is illegal in Scotland (soounds like the law in England as well) You can take your dog out and it can chase vermin ~(rats mice foxes and pigeons) but only with one or 2 dogs, not 20 odd.

> You can take your dog out and it can chase vermin

Not really, it can flush them out to be quickly and humanely despatched :-)

In Scotland the law says that a dog under control can flush out mammals for the purposes of pest control, under control basically meaning a dog that is trained for the job. So, if Tchi gets a hare up he mustn't chase it but he can still catch and eat rabbits!

In Wales where I am the hunt still goes out but they call it exercising the hounds. They are a pain and take over the whole mountain with no regard to anyone else who might be out that day.

No, hunting in England is still legal,  but has to comply with the law..

No, foxhunting is still legal, but has to be done in certain ways.

>So if I asked on here for a hunt to come and kill foxes on my land with dogs then I would be wrong

You can still ask a hunt to arrange for a couple of hounds to be brought to your land to flush out and shoot particular problem foxes; that's always been the case. However the full-scale hunts have to be done differently to how they were in the past.
