Topic Other Boards / Foo / Roundabout - who has right of way ?
- By St.Domingo Date 04.09.09 10:00 UTC
I approached a roundabout yesterday . Myself and another car arrived at the same time and neither of us was on the roundabout , we were both giving way .
I was at 6 o'clock going straight ahead . She was at 12 o'clock turning right ( ie. cutting across my path and going to my left )
Who had right of way ?

The car to your right has the right of way, as I understand it .....which can lead to confusion when there is someone at each intersection!

There was no-one at my right . She was straight ahead of me , therefore i was on her right as much as she was on my right !

That surely must have been a mini roundabout because at 6 and 12 o'clock you both had plenty of time to move onto the roundabout?

She was actually on your right if you go anti clockwise from your position(which is what is meant by giving way to traffic approaching from your right)The Highway code actually has a diagram at the bottom of the page on the link which is very similar to your scenario above

St Domingo i understand what you are saying in that yes you do give way to the right of oncoming traffic on the r/a and also anyone joining it also. But when you say that you were the only 2 cars arriving at the same time and then both giving way to each other some one has to make the first move onto the r/a. I normally start edging forward to see what the other person does or i may put up my hand to give them the go ahead to enter onto the r/a first if its a very small r/a, the larger ones you should have enough time for the both of you to enter at the same time without crossing paths.

I'm going to add my bug bear here when people go on r/a in the wrong lanes, cutting up people as they exit and then looking at the others cars as if those drivers are in the wrong, winds me up a treat that one. Also if you pick a lane stay in it, i see so many people who move from lane 1 to 2 and then to 1 again cutting many people up and causing havoc on the r/a!!!Grrr

You always give way to the right.

I take it you looked right at the 3 O'clock exit whilst coming up to the roudabout and saw it empty so just drove straight to your left, as did the 12 O'Clock driver look at the 9 O'Clock exit and just drove straight out, obviously faster than yourself to get around to the 6 exit and cut across you to exit at the 9 exit. (Is that right)

If that is the case then I'm afraid that it would be classed as your fault if you both came too close, (soz :-( ) the lesson is to slow right down whilst reaching a roundabout the second car had no need to look to their left at yourself whilst pulling out at all whereas you did, as the car was to your right, you always give way to the right.

Granted the second driver must have been driving way too fast to reach you, but the law is you give way to the traffic at the right. :-)

Yes it was a mini-roundabout in an out of town shopping complex .  I was not signalling as i was going straight ahead , she was not signalling yet she was turning right in front of me and across my path . We both reached the give way line at the same time .
I went to go forward as she was not signalling so i assumed she was going straight ahead . I then slammed on my brakes as she swung her large black Range Rover style vehicle onto the roundabout and in front of me . We didn't crash but myself and my daughter had to put up with verbal abuse and gesticulating (sp) by her passenger .

I think she was desperately trying to get a parking space close to M&S so her hair didn't get wet .

The lack of respect and bad attitude just gets me down . I would happily give way to anyone just to keep the peace .
The more i experience people the more i stay at home !

(If this had been at a junction i would have had right of way as she was going across my path .)

:-D

I can fully understand why you pulled out then if she did not signal to tell you any different. If it's any consolation many of us may well have done the same. :-) I've learnt over the years that you have to sometimes have a 6th sense, the roads are full of idiots who don't indicate or often indicate the wrong way.

I've been caught out a couple of times by someone on a roundabout indicating a left turn before me to then continue to carry on when I'm just pulling out. And oh boy can't count the times I've seen someone cut across a roundabout, they were made to go around!!!! :-D

In your case I would have definitely done my 'clench fist in' and then 'open' several times to indicate no indicator was used, it must have scared you to death.

There are bad drivers everywhere, you literally need eyes in the back of your head.

Edited to add IMO as this driver did not indicate and also drove across a roundabout, it was not your fault! ((Big Hug))

IMHO she was more at fault for not signalling when turning right on the roundabout but regardless of who was at fault you didn't deserve verbal abuse, especially from a passenger who probably had no idea who was at fault! Pillocks who can't follow simple rules like sticking to the right lane and signalling correctly on roundabouts shouldn't be driving at all!

Highly recommended!  Find it difficult to take that calmess away from the lesson though.  As for roundabouts - I had a loud horn blast a few weeks ago on a busy roundabout where if you sit and wait for a big space you will be there all day.  I had noted the car coming round the roundabout had come from 9 o'clock and assumed that he was leaving at 6 where I was waiting.  He wasn't signalling.  I went and heard a loud toot behind me to find that he had revved up and come right round the roundabout like an idiot - in my mirror I watched him go around again behind me too.  No reasoning with folks like that I am afraid.
