I am very interested to  hear of other peoples experiences of the kennel club lifting breeding restrictions on dogs that have been sold with restrictions, are these really worth the paper they are written on.  In these times when there is so much condemnation of breeders not taking all precautions to breed sound dogs, the kc lift restrictions against the breeders wish's, even when a seperate   contract has been signed, can  any restrictions really be enforced.

I would really like  to know if anyone has had and experience of appealing against the KC

The registration forms say if the endorsements are properly applied then they will not be lifted.

One of my pups went to a family who originally wanted her for breeding.  It ended up that one of the pups, that was slow to feed from birth, actually had a cleft palate (very small) so I notified all the new owners that restrictions would be placed on the whole litter and not removed.  I gave this family the opportunity to change their mind about having the pup, but they said they had decided just to take her as a pet.  18 months later they got in touch with the KC to ask them to lift the restriction, the KC then contacted me, thankfully I still had all the documents that they signed, saying they knew and understood why the restriction was there and knew it wouldn't be lifted.  The KC refused to lift it.............but just out of spite, the family then rehomed the pup without letting me know or even bothering to take the family's details.  It took me a year but I did find her in the end.

So thankfully because I had done everything right regarding the restriction, it stayed in place and the bitch was spayed when she went to her next family!

this has been discussed many times before but i think if you sold pup to a friend/family member and didnt mention restrictions, kc will lift them and then you buy back and hey ho- no restictions!

It generally does not matter if the pup gets sold on to a third party with no knowledge of the endorsements, the endorsements will still stand as long as they were correctly placed in the first place

Kennel Club - Information Guide on Endorsements

4 ........ If subsequent transfers take place, the endorsement becomes a matter between the parties involved. In such cases the registered owner placing the endorsement shall not be responsible if notification of the endorsement is not given to any new owner, and may exercise his right to decide whether the endorsement be maintained or removed subject to (5) below.

That is incorrect.  The endorsements will not stand. They kennel club have updated the paperwork also to reflect this.

I think you meant the endorsements WILL stand????

this is what i mean, this sentance maskes it sound as if they can be lifted between parties, as i said, if sold to a friend etc?

It means that any issue that the new buyer has about the restrictions is with the person who didn't inform them.  In the case of the resale value, non disclosure etc.

Doesn't mean anything about removing them.

The Kennel Club closed this loophole a while ago & IMHO quite rightly

Ive dealt with this recently and this is what i have found.

KC will NOT lift endorsements if: agreement was placed when puppy was in physical possesion of the breeder or person placing endorsements. Agreement was signed and breeder or both parties have an original copy of this agreement. If a puppy was sold on and the new owners were not aware of the endorsements tough as original agreement stands but the new owners can take the case further i.e they were told about the endorsements misrep etc etc.
