Topic Dog Boards / Breeding / HELP, BREEDING TERMS CONTRACT STILL NEEDED TO LOOK AT!
- By Chezza77 [gb] Date 06.07.07 08:37 UTC
Hi

I have asked a few of you already wether anyone has a sample of one and alot of you had said no and not to go down that route.
My friend who is also a breeder of my breed, wants a puppy from us on breeding terms. We have agreed in principal so far that I will pick and pay for the stud used, the bitch will stay in my name for the litter and won't be transfered over to her until she gives us the 2 puppies of our choice. This we are both happy with. But I want to mark out all this on a contract, along with that she raises and pays for the care of the litter when they are born etc...
Can someone help with showing me a sample of this type of contract?

Thank you all again.

Chezza :-)

You'll also need to decide and put in writing what will happen if the bitch fails to conceive; if none of the litter survive; if there is only one or two puppies; if there are no puppies suitable for you (mismarks, bad mouths etc) ...

Oh, and specify who's responsible for all the expenses of the litter (vet fees for emergency caesarian, etc). You say she's happy to pay for the costs after the litter's born - what about before?

And you'll need to cover the possibility that in the two or three years between taking the puppy and her being old enough for a litter that the pup might turn out to be unsuitable for breeding, or the owner might not be in a position to manage a litter (illness, employment etc).

Hi

Thanks Jeangenie & Admin, I will make sure I have it all down on  the contract and ofcourse will endorse all puppies, as I di from the litter I have just sold.

Best wishes

As Jeangenie has stated, you need to cover EVERY eventuality and make sure you get EVERYTHING down in writing with copies for all concerned. It is not uncommon for this sort of thing to turn very nasty indeed. Even a written contract may not be watertight in court unless you have had a professional draw it up. Another thing to consider is the matter of which puppies are registered and whom has the final say on that. As a breeder, would you wish mismarked or 'faulty' puppies to be registered in your name/affix? Something to consider. Don't forget endorsements :)

The kennel club do a loan of bitch agreement which will cover a lot of things and
personally they seem to decide what is registered etc above the law lol.

Hi

Would the loan of bitch work in the instance that the Bitch will reside with my friend, but still registered to us. I really just wanted to make sure we got her 2 pups and that they are in our Affix and not her's really. Thats why I wanted a Breeding Contract made up or someone suggested a Keepers Contract, any idea what you would write on that? As she will be whelping and taking care of the litter not us.

be very careful. you cant think of everything when you are deciding on terms. i also put a bitch out on breeders term to a very close friend. we had a major hiccup a situation arose that we hadnt thought of. i ended up with the puppy back and have lost a very dear friend. it wasnt worth it at all. please think long and hard before committing yourself. there could be alot to loose.
