Hi,

I don't know if anyone will be able to help. I took out a bank loan to help my brother as he was unable - I know stupid:rolleyes: I had an agreement drawn up to protect myself with a clause enabling me to retrieve the monies 'on demand' which was signed and witnessed by all parties. I have now requested the outstanding balance as our relationship has broken down and my circumstances have changed leaving me with no alternative. I intend carry on with the repayments and use the money to my advantage - a business venture and do not intend to settle the loan. My question is, am I within my rights to request the outstanding balance or could he argue to pay only the settlement figure?

I know this is a strange one but would really appreciate any advice.
