on Wednesday night i took one of our dogs to the vets only to find she is pregnant, i dont have any entire males in the house, but after putting two and two together i know how this has happened.
i went away for the weekend quite a few weeks ago and my aunt and her daughter stayed in our house to look after our dogs, as i dont like to put them in kennels.
my aunt says that over the weekend that i was away my brother came around with his dog and due to an incident that happened all the dogs got left together in the house on their own, but my aunt knew that my dog was in season as i had mentioned it to her, as she is not allowed up onto the furniture when she is in season.
i know that this is all down too my brother and this was all pre-meditated by him, i did not intend to let my dog have a litter, as on Wednesday she was booked in to be spayed so this has come as a complete shock to me.
i was wondering if there was anything i could do legaly? as i feel totaly betrayed.

I will have to go with NO on this one, nothing you can do on this one as it would be near impossible to prove intention.
But, and even if you could if you girl is a pet only, I mean not shown or a broad bitch then all you could claim is the cost incurred to put her right.
When you sue someone it is only for loss. Loss of today's losses and if they was a possible furture gain you could claim that lose but very very unlikely. IE a top show champion.
Put it down to lesson learned I think. Strange thing for someone to do..

Legally, I doubt if there is anything you can do. If you really don't want her to have a litter, then go ahead and have her spayed.

I don't see how you can prove anything. You only think it was your brothers dog - OK very strongly - but without hard evidence don't see how you can do a thing - including getting him to pay for any treatment.

Hi there what breed is your brothers dog is it the same? if not then i would just take her in and have her spayed now, if it is the same breed then that is up to you are they both very good for the breed do you show ? are they KC reg. if none of these then i would go ahead and spay but all said and done its up to you, this is why my house dogs go into kennels if i have to go away, my own kennel dogs get looked after by my son. Are you the one who's brother bought the dog specifically to use as a stud dog and asked you to use your bitch, or am i thinking if someone else? If so, what does he think he will gain? even if you sold the puppies surely you would be the one to get the money and not him? What a nasty thing to do though, is abortion an option with dogs?

yes he did buy his dog to be used for stud work this is why i know it has been done deliberatly, i am not decided yet wether to still go for a spay or to let her have the pups, both i am sure will be of risk either way.
if i do decide to let her have the pups, i will be giving them away with endorsments in place.
it has never been my intention to let any of my dogs have pups. i had his dog here for a while as his wife beats the hell out of it, but sadly my hands are tied the RSPCA i have refused to call because of what happened with Cass, and i couldnt keep the dog as legaly (on paper) the dog belongs to my brother, i had the police come here and collect him and i was cautioned for refusing to directly give him back to my brother.
so i was in a no win situation.

Do you think your brother has any intentions of asking for a stud fee?? and that's why he has done this?

Sorry to hear about your predicament, but should you let your girl have the pups, then your brother has achieved what he set out to do.

Unless you have your brother (presumably the registered owner of the dog) sign the litter registration form, you won't be able to register the pups (or put endorsements on them) anyway?

Your best bet would be to proceed with the spay, taking the pregnancy away. This can be done quite late into pregnancy, though not ideal should be safe, with a little extra care and watchfulness.
It will certainly put paid to your brothers schemes also. Better than a potential ceaser and an unwanted litter a little later. :(

Having pups I believe is far more risky than spaying anyway (or so my vet will tell me)

Hi,
I thought i would let you all know my pregnant bitch is booked in to be spayed tomorrow, im a little nervous and worried for her, but i am positive its the best thing to do for her.
i will let you all know how shes got on when shes over the worst tomorrow.
