Thanks, I did also but jst found discussions not samples.
I am fine with all the legal implications and how this works but just wanted to see what everyone else has in theirs so that mines are nhot OTT or not detailed enough.

Hi Melody.
I had a ball going through some of the posts from 2001, Although for a while I was regarded as new I actually joined in spring 2001, some of the old posts were good. I lurcked for a while.

Hi Brainless could you let me have a copy to please ?
Ive lost heart a little with regard to the breeding endorsements I sold a bitch for half the normal price 2 1/2 years ago months ago with a endorsement because she had l white patch on her chest and I didnt want her breeding from I made the people sign a agreement to say they new she couldnt bred from and they seemed genuine nice people who only wanted a pet but they went on to mate her up at 18 months old and asked me to remove the endorsement because they wouldnt be able to register the puppies with it on. anyway thankfully she didnt get pregnant and I have since managed to buy here back at nearly twice what they paid for her and she has now been spade and lives with my aunty.
I am at a loss to know how you can prevent this we did everything we could , the lady visited me twice and I visited her before she took the puppy and she seemed a really nice genuine lady she had a spayed westie as well so It never occurred to me that she had any intention of breeding from this bitch I was horrified

Admin, If that was directed at me that was a little rude. and also a bit of jump to conclusion :-(, I perhaps thought Brainless had updated or changed it and I , once had her addy was going to then ask about breeding contracts or if she knew anything about then as you will see the links don't have this and my original question was for both. :-(

Hi everyone
I have a question! what happens regarding the kennel club breeding restrictions if the dog is passed to a third party? I ask because I know the Kc say you must supply and get signed a statment saying the purchaser is aware of the endorsement or they will not honour them, so if the dog was sold on with out the new owner being told would that affect the security of the restriction and if it does is there anything you can do to prevent it?
The first owner is supposed to be responsible for telling the second owner about the restrictions

Hi Kate,
As Christine says the first owner should tell the second but there has been reported trouble with this also. It makes you wish you could insist they had to bring the dog back to you. Still worth putting in puppy contract though even if it cannot be enforced. To deter the ones who don't know.

The KC say that the endorsements must be signed for to be enforceable, so simply telling the new owner wouldn't be enough. As I understood it, it is up to the breeder to track down the new owner and get them to sign to accept the endorsement :(
I did put in my contracts that the dog was to be returned to me if the owner couldn't keep it, but as you say Pam, we cant force them to bring the dog back.

Think you are bang on. Think it is worth adding that to the original contract also, that any new owners need to sign an agreement also and that is a condition of the original contract.
I know contracts can certainly get complicated , hence the reason I was asking for everyones as I drafted one and it was about 3 pages LOL so thought I would try and slim it down LOL .
Luckily , I do believe that the genuine purchasers are happy with these conditions , the ones who oppose them the most are the ones who IMHO are likely to want to break any terms.

Pamela, can you add your final draft to the other thread so that others can use it for future reference? :-)
I think I would like to see Pam's first and final drafts - she probably has some ideas that I could use to make mine even more OTT but it has evolved over time as things have come up.
Does anyone else do a separate "tips" sheet or do you incorporate it into your contracts?

I think a seperate sheet is quite good also. Someone post a puppy sheet through the eyes of the puppy which I have saved and plan to attach also.
Can't remember who but someone told me your contract was excellent. :-)
I am still throwing mine around but have taken bits form here there and everywhere.

I always give Sherleys Dog book, which has a lot of useful common sense info, and just mention the feeding, worming and taking to classes advice in mine. in mine.
How much is the Perfect puppy, and can anyone scan me the cover, so that I can print it off so the new owners will know what book it is?

The way I understood it, when I checked with the KC is that having the endorsement signed and accepted refered to the first owner who purchased from the breeder, andy subsequebnt owner cannot get the endorsement lifted due to ignorance, and could only take action against the seller for not selling them what they thought they were getting.
The endorsements will stand. The reason the KC now want something signed is that new owners would get dhirty and say they didn't know, as sometimes they would have entered into the buying process befire registrations were available. It is up to any subsequent buyer to check what the Reg says as far as I can ascertain.
Well hopefully thats good news! I was worried what would happen if a puppy ended up with a third party
