Hi all hope you are all staying safe. In a bit of a situation here and would appreciate your experience and advice, I'll try to stay succinct!
Stud agreement from first contact was that stud owner wanted a bitch pup from my girl. If no bitc pup then stud fee.
My girl had a Litter of 6 , 2 bitches. He came to see them at 6 weeks and we discussed which bitch we would each be keeping. His adult (40s) son came to view the litter and choose a dog pup to buy.
At this point the other 2 dog pups were booked. So all good you might think. WRONG!!
On the day they were 8 weeks (last Saturday) I recieved a call from the stud owner to say his son didn't want the dog anymore and he didn't want the bitch either. He said his own bitch had a litter so he would be keeping one of hers.
So I'm left with 2 pups I hadn't planned to keep. In normal times no prob. I have puppy buyers waiting but with the way things are this is not happening as some of them where in England etc (I'm in NI).
Keeping them here is not the problem.
Stud owner is now asking me for the stud fee he says he is entitled too £500
What are your thoughts??
Had I had earlier notice I could have got new homes for the puppies I have been turning people away for weeks.
Really feel I have been left in the sh*#. I used the money from the sale of the other 3 to pay credit card bill for expenses from the litter. Idexx, herpes vacc, c section, food ,parvo and first vaccination. I always do it that way so I can see my expenses easily.
It's not so much the money anyway and the pups are happy and safe with me. It's the face that he has changed the terms of our aggrement.
Maybe I am wrong so an objective opinion would be great. Thanks
DO you have a written contract? I would tell him he has to wait for his money until the 2 puppies are sold
The agreement was all written via email and in those emails an agreement was clearly stated and agreed by both parties.
It included situations such as no bitch born or only 1 bitch
If my bitch didn't take
If only one pup born

To be honest, I'd be thankful that neither will be having a puppy and pay the stud fee.
I'd not want to be dealing with people like that and at least YOU will know where these puppies are and who will be lucky enough to be buying them even if it takes a touch longer before they leave you. I'd not want ANYBODY coming onto my property just now.
Unfortunately stuff happens, but usually for a reason, however annoying at the time.
Please don't give people 'a pup back' when you breed. It very often results in situations like this. There is a very long time between mating a bitch and pups going home at 8wks and all kinds of things change.
When you pay a stud fee, you are paying for that service, at that time. Payment should be at the time. Everyone is levelled and equal and nothing is owed to anyone.
If a stud owner then wanted to buy a pup, he would be treated like anyone else purchasing a pup from you. That is a completely separate contract.
If he's not happy with that, use another stud.

This is very true and peoples true colours eventually shine through..

As has been said, it's better in my opinion to keep the stud service and having a puppy from the resulting litter as two separate situations. All too often arrangements like that lead to problems. We always took a fee for the 'service' only. I know in my breed, more and more it seems breeders do this take back puppy arrangement - very little money changing hands although given the huge gap between a stud fee and the cost of a puppy these days (in the past the stud fee used to be pretty much the same as the cost of a puppy), I'm not sure how that works, unless people perhaps take back 2 puppies in lieu of a stud fee?
That's not for me I'm afraid - I had a hard enough time with a litter from our Canadian import by an American import where there were 4 surviving puppies (of an original 9 - vet incompetence). I had a lot of interest!!
I own studs and if I want any then I go on their waiting list like anyone else! They pay me the stud fee as paying for a service!
