
In England from October you will need a breeding licence if you breed 3 or more litters within a 12 month period or are in the business of breeding dogs for sale (breeding dogs to sell with the aim of making a profit) even if breeding less than the litter limit. The business test is open to alot of interpretation and personal judgment when the litter amounts are under the 3 litter limit, so each council may be slightly different on what they consider in the business. The old law also included the breeding as a business but the old limit was 5 litters in a 12 month period. So realy all that's changing is the litter limit is lowering and more emphasis is being put on the business test as council's tended to ignore it as its so much harder to police.
