Topic Other Boards / Foo / Buying a property with 'overage provisions'

Has anyone ever bought a property with an 'overage provision' attached? Was it more trouble than it was worth?

"The sale documentation will include overage provisions reserving to the Vendors a 50% share of any uplift in value resulting from the grant of planning permission for any additional residential dwelling on the land which will be payable upon grant of the permission".

People next door managed to get the overage removed when they bought their property :)

:) I suspect that the overage was dropped by the vendors as it, probably, would have depended on the grant of planning permission for converting a large barn. This might/may be a problem as the property is outside of the village settlement boundary.

The existing property was supposed to be demolished and a new house built which hasn't been done yet - 5 years after planning permission was granted (the foundations have been built). The occupiers have chosen to remain living in their caravan and spend their money on wind turbines and solar panels instead - so conversion of the barn (let alone the building of the house) won't happen for many years, I suspect :) :) :)
