Well haven't been visiting CD much no internet or phone and BT taking an age to sort it out. Well after having all my operations on my hand following a dog attack I have now slipped at work on a spillage someone didn't clear and broke my  arm on the same side.As I have had so much sickleave due to my ops I have struggled into work with my arm in a cast .I have just been told that as I am on light duties as are 2 of my colleagues, they want to cut my hours by 8 hours and not be paid for them.I am really cross and let down.No wonder people pursue injuries with these no win no fee companies if this is employers attitudes.

It may not be too late.  Was the accident fully reported at the time?
I'm not into the claim everything culture but health and safety at work are a different matter and they really do have a duty of care.

Is it worth going to citizens advice to check out what your rights are?

That's not nice.....

I'd be tempted to get signed off sick again.

If they treat you like this do they deserve commitment on your part?

cornishmals, speak to the Acas helpline:  08457 474747 (Monday-Friday, 8am-8pm and Saturday, 9am-1pm)

So sorry you have to deal with this on top of everything else :-(

The incident was reported with witness statements and cctv was requested though I am not sure if anything was filmed .The individual that caused the spillage has admitted to it and said he was going to clean up but was asked by his team leader to do something else. Incidently the t/l has been sacked due to misconduct with an untrelated incident.I cleaned up the mess. I was seen by 2 first aiders as the first one was rubbish and thought I was fit for work when I knew I had done something to my arm.I was taken to A&E put In back slab and returned to work on painkillers.when I had my fracture manipulated and put in a cast I took a weeks holiday.I don't know why I bothered. But I am only entitled to SSP as I used up my 6 weeks paid sickness with my ops.

Unfortunately I think sick pay entitlement is all laid out in your contract and there is no getting around that but this was an accident in the work place for which you were not at fault so I do think you are entitled to compensation.  I don't suppose you have a union do you?

You also need to report it to Social Security and get it declared as an accident at work. If you get a medical certificate from your GP there is a section that you fill in to say it was an accident at work - it's really important that you do that because if it causes problems in the future you may well be entitled to Disablement Benefit. It's been years since I worked for the then DHSS but I used to deal with Industrial Accidents and although the process has probably changed over the years you must declare it to them and make sure it is recorded.

I was going to say are you in a union ? I had some issues around sick time etc and the union were very helpful.
Otherwise a word with a solicitor maybe ? one of the no win no fee ones could be useful. I know it may be against your principles but sometimes you have to look after yourself first and this sounds like it needs someone on your side looking very carefully.  They should have employee liability cover so the circumstances around your injury need to be carefully looked into if there is any possibility that they are to blame.

You are entitled to loos of earnings and your HR dept should be on top of this.

Acas is your best bet and hope you get it sorted
