I had a call last night from a breeder asking why i'd allowed my stud dog to be used on a bitch he'd bred but who hadn't had her hips or eyes tested, and had breeding restrictions on her. I would never do this, and as a member of the breed club know it's not ethical.

After a long conversation, it transpired that the woman he sold a bitch pup to a while ago had taken it upon herself to breed from her without informing him (or transfering ownership to herself!) When he asked her the name of the stud she'd used, she gave mine! I've emailed the KC to inform them i've never met this woman and asking that they don't put my dogs name on her pups pedigrees should she try to register them. I've offered the KC a sample of my boys' DNA if they need it. Obviously, i haven't signed any forms, but can she register her pups online without my signature?

I'm furious that she could do this, but is there anymore i can do? I don't want people believing i don't care about the dogs welfare! I have her email address (and have sent her an email making it clear i'm not happy!) but don't have an address or contact number for her - that's probably a good thing due to my current mood :<

She can't register any pups who's parents have breeding restricions.  So you should be safe.

There is no way she could register pups with the KC if there are breeding endorsements on the pedigree of either dam or sire.
I'd still be very peeved though if she is saying your boy sired the litter and this wasn't correct, surely something can be done in the civil side of the law as she is going to be selling pups and stating that your boy was the when this is incorrect, trading standards may be able to assist further as well.

The breeder of this bitch should be able to help with an address and phone number if you require it..
Is she part of the breed club at all? I would be reporting her to them as well.

The bitches' breeder has said he will remove the restrictions if this woman has her girls' hips scored / eyes tested and gets satisfactory results. She'll then be able to register them with the KC, but where does that leave me? She DIDN'T use my male, and i'll do everything in my power to prove that - but do i actually have any power??

I'm worried sick.

As far as i know, she's not a member of the breed club. Her bitches' breeder does not have a phone number for her, and she's recently moved so he can't give me her current address unfortunately.

Well I read it that she didn't inform the breeder but it wasn't made clear if there were any breeding restrictions on the bitch. If she tries to register the pups then  two things. 1) She hasn't changed the bitch into her name and so therefore cannot register them and 2) She hasn't got a signed Litter Registration form from you and if she tries to register them online then they send you a letter asking to confirm the mating, so you should be okay. However, I would put everything in writing to the KC registrations department and e-mail the woman stating that you have been in touch with the KC and that should any puppy's papers (non-KC registered) state your boy as the sire you will most definitely take the matter further and take it down the legal route.

Just seen this post. The KC will not register the pups without a signed form or your consent but do write to the registration dept outlining that the mating has not taken place.

Well you haven't signed any forms.  I doubt that the woman will do hip and eye checks, she has behaved irresponsibly up till now, why would she change that habit.  I think that you should be safe.  But informing the KC of this situation is the right thing to do.  Hopefully that will put a little flag by your dog's name so that if she does try anything then the KC can stop it.

As an aside, if she does use your dogs name and pedigree, take her to court for a hefty "stud" fee - you could also tag defamation of character onto that too as the fact this woman is alleging to have used your dog, it could be damaging to your reputation.  I'm sure that'll make her think twice.  I would advise you to monitor the puppy sales sites to see if any litters look to be her one as she may still use your name in her advert.  KC-wise though, I think you are safe.

Thanks everyone for your advice, i feel a bit better knowing she can't register pups without my signature.

I've emailed the KC already, didn't think to inform the breed club but i'll do it right now.

Might be an idea to send your email to the KC as a letter as well - then they will have a fresh copy of your signature?

Good luck!  I know it is worrying, but being open with the breed club should set the record straight before anything happens.  Also, this woman might use another dogs name if she finds out that you know what she is up to.

karen, if she registers puppies online with the kc, the kc will contact you by phone or letter to confirm the mating,
