Does anyone know (for a fact) the answer to this query please?

Kiwi marries Brit and lives in Britain for 14+ years.  Children are born in Britain but mum insists they have Kiwi passports.  12 years on mum goes back to NZ taking children with her.  Children coming over regularly but now one child wants to come back here to live with dad and mum is having none of it.  Can't find anything official about getting dual nationality passports, surely the children should be allowed these considering they were born here, lived here until 2 years ago and their dad is English?

You maybe already know this Cheryl but there are other issues than passports if the parents are in dispute over custody.  I think we have agreements with most civilised countries to agree with whatever is passed in the court of the country they are presently residing in.

The anawer is sort of yes try this Mum Aussie Dad UK born living in NZ Mum wants to come home to UK Dad remarrying Kiwi Dad will not sign the forms to let daughter have UK passport! so Mum is stuck in NZ causes Dad is a bastard!!

If both parents agree you can have dual passports BUT they have to be applied for before marriages go up the creek!! If both parents dont sign you dont get a passport.

That's the problem.

Will the children be able to apply for dual nationality when they are old (16) enough to renew their own passports? 

Im afraid not its 18 and they may have a fight for it!
Same trouble with one of my great nieces Paige! she is 4 now.
But she does visit us and we go to NZ but if we were any less well off we could not see her at all.

Even though they and their dad are English and they lived here for the first 8 and 11 yrs of their lives?

The passport application needs to be made to the British Embassy in Wellington - it can't be done for the children in England.  It is possible for the children to have a British passport, it'd be granted via descent through their dad (my partner did this in Australia and she was born in Australia to a British born father) but their dad won't be able to do it without his wifes consent.

As children can apply their own passports at 16, there is no reason they cannot apply for British Dual Nationality/Passport at 16 or any other age after that in their own right

Does not work that way it should but they aren't adult at 16 and both parents have to agree to dual passports I have no idea why but Terry has to give his permission for Paige to have her's and he will not, and he is the British half. He says he left his family to get a better life in NZ and he will not have her leaving him and going with her Mum to UK, so they cannot go.

They can apply when they are 18 I know they can because my friends children did & now all have dual Australian & British Nationality despite her ex refusing to consent to anything. They would have right to reside in the UK because they were born here to a British National
