hi everyone this is first time on here and hope you can give me some advise.we bought a puppy last year advertised as show potential and front second to non as we are novices we thought it best to go to a breeder who has been in the breed for a number of years anyway we contacted them and explained our wish to show and maybe breed in the future with our girl after a long chat and reasured the pup in question was a great example of the breed we sent off a deposit to secure him as it was a long distance away.we collected our pup a couple of weeks later and again was reasured about it.at 7 months he began limping and after visit to vet we were left devaststed when told he needed operation a.s.a.p as he has a grade 3 luxating patella on left hind leg we did not hesitate to agree to operation as it was in dogs best interest and vet also told us he has carpal valgus of both forlimbs.we were advised to also have him neutered as it was hereditary this we also had done we explained all to breeder and after they demanded medical report from our vet which we also arranged at our expense as well as medical cost we were promised a replacement pup as obviousley we cannot show or breed from him.they then asked for £600 to have replacement pup saying they have made a discount we refused and after many e-mails they agreed refund of price of pup but we have recieved nothing because they want us to send them a letter stating they have paid us and they no longer owe us anything before we have recieved a penny!!!!! what do you think and is there anything we can do about it? all opinions and advice welcome.
I would contact the kennel club and ask for their advice if you are getting no where with the breeder. They were going to help me with an issue I had about papers. The pup was nearly show age and I hadn't received any. I didn't need any help in the end but they where going to contact the breeder for me.

I dont think the kennel club will do anything. I dont think the breeder leagally has to refund the money or give a replacement pup. I would notch this one down to experience and move on.

Difficult one this, too many variables and picking 'show quality' puppies is not an exact science.
The very least this breeder is guilty of is being stupid enough to virtually guarantee that this puppy was a potential winner.
As to the other matter, the puppy's development, then you are into a minefield. Carpal Valgus syndrome can be attributed to rearing techniques too and would be very difficult to prove that this breeder was aware that the condition could affect your pup. Is health screening for L.P. advisable in the breed and if so were the parents done?
Without both sides of this argument it will be very hard to advise.

I would not sign
anything to say I'd received money if I hadn't. Why do they expect you to sign a receipt like that?

To be fair, the OP said the puppy was described as having 'show potential' which is a rather different matter.
To be honest I have got three dogs which I considered show potential at 8 weeks but have grown up to be not quite as great as I thought! I have champions os consider I do know what I am talking about but things changed from a wonderful pup. The health issues well I dont know anything about the conditions or whether it is a condition to the breed but am assuming it was not present when the puppy was sold.
I was sold a puppy I waited two years on a waiting list for from a top breeder but she has not grown to the correct height he had no way of knowing how tall she was going to be when he sold her too me. I was dissappointed but I love her still so we just have to put up with her fault.
The kennel club may help with mediation as it was going to do in my instance. In my breed they say - he needs to watch himself or he'll be kennel clubed if some exhibitors over step the mark a little. If the breeder has been in the game for many years I was thinking more of him loosing face or being worried about his reputation if they got involved rather than legality's. Is the breeder a member of the Acrredited breeder scheme again if he goes against the scheme rules he can be suspended doesn't stop him selling pups or breeding just looks bad for him. All threads very true - its a hard one and two sides to every story. Just hope that the pup is okay and is enjoying his life albeit not in the show ring.
But to be honest the pup was 7 months old when this ocurred and the breeders have offered them a another pup albeit not show standard. I think this is a generous offer to be honest. My guess is legally they are not obliged to give them anything as it happened several months after the pup was living with the family. At what point is the cut off.
The kennel club I very much doubt would be interested. They could try the breed club however in my opinion they would not be interested either unless it could be proved the breeder had knowledge of the problem prior to selling the pup. Breed clubs and the KC have complaints daily. I really do feel sorry for them but the fact remains they were offered another puppy which they have refused.
